CORRECTED LETTER
This letter replaces the letter dated April 19, 2005. The only change in this letter is item #13
that describes the effect of the 1992 addition of right of way on the existing parking and
the mention of this issue in item #8.

Dear Ms. Schmitz:
You have asked for a letter that provides an analysis of the zoning and other information
regarding the referenced property. This letter is based on a review of our records and an
inspection of the site.
1. The above referenced property is zoned Highway Commercial- HC and
Commercial- C-1. A copy of the zoning map showing the line between these
districts is enclosed.
2. The property contains a variety of uses that are specified on the enclosed
spreadsheet titled Greenbrier Square Parking Revised April 6, 2005. The uses are
approved by zoning clearances and are in accord with the approvals and
determinations listed in #6 below.

3. The adjacent parcels are zoned Highway Commercial- HC and Commercial- C-1.
4. The parcel is in the Airport Protection Overlay District.
5. The property is not part of a planned development.
6. The property is subject to the following rezonings, special permits, variances, and
determinations:
• 2/14/85 ZMA-84-32 rezoned 4.34 acres from C-1 to HC. This was approved
with a proffer that limited the uses. This included what is now Parcel 5, the
subject of this letter, and Parcel 5A.
• 8/7/85 ZMA-85-18 amended proffers of ZMA-84-32 to allow hotels, motels
and inns on the portion of the property that is now Parcel 5A.
• 10/1/85 The original parcel was divided into two lots; Parcel 5, the subject
property, containing 3.1006 acres and Parcel 5A, the Motel 8 site, containing
1.2287 acres. A copy of the plat is enclosed
• 3/21/90 ZMA-90-01 amended proffers of ZMA-84-32and ZMA 85-18 added
fast food restaurants to the list of permitted uses.
• 11/7/90 ZMA-90-05 amended proffers of ZMA-90-01 and ZMA 85-18 added
church to the list of permitted uses.
• 11/25/91 ZMA-91-06 rezoned a 1.2 -acre portion of the parcel located adjacent
to greenbrier Drive to C-1. This action added several uses to those permitted
on the property. A copy of the action letter and proffers is enclosed.
• 11/20/91 SP -91-43 approved a billiard center with conditions. A copy of the
action letter with conditions is enclosed.
• 11/20/91 SP -91-52 approved an emergency veterinary office with conditions.
A copy of the action letter with conditions is enclosed.
• 8/19/86 VA -1986-29 allowed a variance in the number of freestanding signs
from 2 to 3 and a reduction of the setback for those sings from 30 feet to 18
feet. A copy of the action letter is enclosed.

• 1/10/89 VA -1988-81 allowed an increase in wall signage to a total of 500
square feet subject to only 1 sign per tenant not greater than 35 square feet. A
copy of the action letter is enclosed.
4/7/2004 The Board of Supervisors approved a dance hall permit for the space
occupied by El Rey del Taco. A copy of the minutes is enclosed.
7. We have no record of any unresolved zoning or building code violations.
8. There are no legal nonconforming issues affecting the parcel apart from the issue
described in #13.
9. The property is developed in accord with a site plan approved in 1985 and most
recently amended by SDP -2003-003 that was approved on February 11, 2003.
10. The property was inspected for zoning compliance on April 15, 2005. The site
was found to be in compliance with zoning regulations.
11. The parking on this site is subject to the terms set forth in the letter to George
Gilliam, dated March 5, 2004 and the spreadsheet titled "Greenbrier Square
Parking Revised April 6, 2005." Copies of these documents are enclosed.
12. It is the policy of this department to purge building permit files after three years.
Copies of Certificates of Occupancy are maintained on microfilm. Therefore, we
have not retained any copies of Certificates of Occupancy associated with this
project. Furthermore, the absence of a Certificate of Occupancy for the project
will not give rise to any enforcement action. Please be aware that interior
renovation that does not involve a change of use does not require a Certificate of
Occupancy. You may obtain a copy of a Certificate of Occupancy for an
additional fee of $25.00 each.
13. In 1992 the Commonwealth of Virginia took a strip of land approximately 5 feet
wide from the front of this parcel in conjunction with improvements made to
Route 29. As a result, the parking spaces located along the front of the property
no longer meet the -ten foot parking setback. Those spaces that are now less than
ten feet from the right of way of Greenbrier Drive are considered to be legally
non -conforming. No other legal non -conforming issues are identified on this site.
