You have asked for a letter that provides an analysis of the zoning and other information
regarding the referenced property, located at the corner of Pantops Drive and Beverly
Drive in Charlottesville, VA. This letter is based on a review of our records and an
inspection of the site.
1. The property is zoned HC, Highway Commercial.
2. This property is located in the Flood Hazard Overlay District, Airport Impact
Area Overlay District, Entrance Corridor Overlay District.
3. The parcels abutting the property are zoned R-1, Residential, RA, Rural Area and
HC, Highway Commercial.
4. This is not a Planned Unit Development.
5. The Board of Supervisors approved Special Use Permit 1989-70 on October 20,
1989 to allow fill within the one hundred year flood zone. Special Use Permit
1992-38 on July 14, 1992 to allow outdoor storage and display of outdoor
furniture items. Special Use Permit 1999-01 on April 28, 1999 to allow outdoor
storage and display of vehicles. A copy of the approval letters is enclosed.

6. This project was originally approved under SDP 1984-67, signed on December
27, 1985. The site was most recently amended under SDP 2001-111, signed on
June 7, 2002. The site improvements, including the parking, were inspected for
zoning compliance on May 3, 2005. No violations were identified on the site on
that date.
7. In the event of casualty to the project, in whole or in part, the project will be
permitted to rebuild in accord with the approved site plan. If the ordinance is
changed in the future, the site could be rebuilt as in Section 6, Nonconformities.
8. There are no legal nonconforming issues associated with this site.
9. The property was inspected for zoning compliance May 5, 2005. 'A few issues
were identified. Apart from the issues identified below, the site was found to be
in compliance with the zoning ordinance and in accord with the site development
plan that was approved on June 7, 2002 along with the as -built plan signed April
22, 1999.
a) Our records show the building constructed in Phase 2 under building
permit # 2002-948NC has not been issued a Certificate of Occupancy.
b) The final zoning approval is pending until a Zoning Clearance application
is submitted for the United Land Company occupying this building.
c) Our records show a total of 4 businesses occupying this site without a
Zoning Clearance applications approved.

10. A review of our records does not show any other unresolved zoning or building
code violations and/or complaints, apart from the two items identified in #10.
11. Our records show the Certificate of Occupancy has not been issued for the
building developed in Phase 2 approved under SDP 2001-111. It is the policy of
this department to purge building permit files after three years. Copies of
Certificates of Occupancy are maintained on microfilm. Therefore, we have not

retained any copies of Certificates of Occupancy associated with this project.
Furthermore, the absence of a Certificate of Occupancy for the project will not give
rise to any enforcement action. Please be aware that interior renovation that does not
involve a change of use does not require a Certificate of Occupancy. You may obtain
a copy of a Certificate of Occupancy by contacting Kathy Martin @ 434-296-5832

Dear Mr. & Mrs. Seymour:
The Albemarle County Board of Supervisors, at its meeting on April 21, 1999, unanimously approved the above -
noted request. Please note that this approval is subject to the following conditions:
1. The total number of outdoor storage and display parking spaces shall be limited to fifteen (15).
2. Architectural Review Board (ARB) issuance of a Certificate of Appropriateness, which includes:
a. Vehicles for display shall not be elevated;
b. Vehicles shall be displayed only in areas shown on the site plan
c. All landscaping required on previously approved site plans shall be installed on site.
3. No additional outdoor lighting shall be installed without the approval of the ARB.
4. No outdoor amplifiers or loud speakers shall be installed.
In the event that the use, structure or activity for which this special use permit is issued shall not be commenced
within eighteen (18) months after the .issuance of such permit, the same shall be deemed abandoned and the
authority granted thereunder shall thereupon terminate. For purposes of this section, the term "commenced" shall be
construed to include the commencement of construction of any structure necessary to the use of such permit within
two (2) years from the date of the issuance thereof which is thereafter completed within one (1) year. -
Before beginning this use, you must obtain a zoning clearance from the Zoning Department. Before the Zoning
Department will issue a clearance, you must comply with the conditions in this letter. For further information,
please call Tan Sprinkle at 296-5875.

Dear Mr. Wood:
The Albemarle County Board of Supervisors, at its meeting on
October 11, 1989, unanimously approved the above -noted
petition to allow for fill within the one hundred year flood
zone. Property, located on the east side of Rt. 29 North
adjoining the south side of the South Fork Rivanna River.
Please note that this approval is subject to the following
conditions:
1. This special use permit encompasses only that fill
currently in place and the minimum fill necessary to
reconstruct the 60 inch stormdrain outfall;
2. Staff approval of a revised site plan showing fill
currently in place and detailing the design of the
stormdrain outfall;
3. Department of Engineering approval of the amended
grading and drainage plans and calculations;
4. Department of Engineering issuance of an amended erosion
control permit;
5. Certificate of occupancy will not be issued until the
following condition is met:
a. Verification by a Soils Engineer that the
embankment fill (including that already placed) is
compacted and stable. Any fill material found to
be improperly compacted must be replaced;

6. Disturbed areas to be replanted with landscaping equal
to that lost by fill activities that have taken place;
7. Special use permit to be issued concurrently with
revised site plan approval.

Dear Mr. von Lewinski:
The Albemarle County Board of Supervisors, at its meeting on July
8, 1992, unanimously approved the above -noted request for outdoor
storage and display of outdoor furniture items on 9.934 acres
zoned Highway Commercial and Entrance Corridor. Please note that
this approval is subject to the following conditions:
1. Until the applicant has obtained a Certificate of
Appropriateness and Certificate of occupancy for the deck,
there shall be no use, storage, or occupancy of the deck.
2. Staff approval of site plan amendment;
3. Expansion of or addition to the outdoor storage uses,
activities or structures not outlined in this staff report
shall require additional review and approval by the Board of
Supervisors;
4. No banners, spinners, flyers, pennants, floats, tinsel or
other attention getting devices shall be allowed on the deck
or any other portion of the Charlottesville Aquatics space
in the associated building;
