Market St. Suite 101 Charlottesville, VA 22902 RE: Zoning Compliance for Tax Map 49, Parcels 18, 1813, 4A6, 8, 8A, 813, 8C, 8D, 8E, 8F, 8G, 8H, 8i, 8J, 8K, 8L, 8M, 8N, 8P, 8Q,8R, 8S, 8T, 8U, 8V, 8W & 8X The property of Castle Hill Properties II LLC Dear Mr. Russell: You have asked for a letter that provides an analysis of the zoning and other information regarding the referenced property. This letter is based solely on a review of our zoning records. We have not preformed an on-site inspection of the property. Our Computer Assisted Mass Appraisal (CAMA) property records indicate that all of these parcels are in the Rural Areas Zoning District and are owned by Castle Hill Properties II LLC. Parcel 18 contains four dwellings and nine farm buildings. Parcel 18B contains one structure. None of the other parcels contain dwellings, farm buildings or structures. None of the parcels are in an agricultural forestal district. In addition, our records indicate that T.M. 49-18 contains 286.863 acres, T.M. 49-18B contains 891.679 acres and T.M. 49- 8Q contains 32.88 acres. Our figures agree with the balance of your figures. A copy of your letter with my handwritten corrections is enclosed. 2. All of the referenced parcels are in the Rural Areas- RA Zoning District. The uses that are permitted by right and by special permit in this district are set forth in Section 10.2.1 and 10.2.2. Dwelling, farm buildings and other structures are permitted by right in the RA district. A copy of Section 10 is enclosed. 3. We have no record of zoning complaints or zoning violations regarding uses or improvements on the referenced parcels in our zoning data base. Please be aware that the Board of Supervisors is considering amendments to the Rural Areas chapter of the Comprehensive Plan. Once approved, it is anticipated that Section 10 of the Zoning Ordinance will be amended to implement the amended Comprehensive Plan. 5. The property is not subject to any special permits, proffers or variances. 6. In the event of casualty, the conforming improvements located on the property may be reconstructed to their current location and dimensions. Legally non -conforming improvements located on the property, if any, may be reconstructed to their current location and dimensions in accord with the provisions of Section 6.3 of the zoning ordinance. 7. Each of these parcels is recognized in our records as a separate parcel that may be conveyed, leased or mortgaged. The parcels are subject any restrictions contained in any recorded documents that constitute the chain of title. No new certificate of occupancy or inspection will be required upon the sale, lease, transfer or other chance of ownership. 8. A search of our computerized records back to 1991 revealed no Certificates of Occupancy on Parcel 18. We found a voided residential building permit for Parcel 18B. There is an open building permit for a farm building, 97-1863 FB, on Parcel 18B. It is the policy of this department to purge building permit files after three years. Copies of Certificates of Occupancy are maintained on microfilm. Therefore, we have not retained any copies of certificates of occupancy associated with this project. You may obtain a copy of a certificate of occupancy for an additional fee. The absence of a certificate of occupancy for the project will not give rise to any enforcement action. A certificate of occupancy will only be required to the extent of any construction activity in the future.
