Cellular Materials International, Inc. 2 Boar's Head Lane Charlottesville, VA 22903 RE: Tax Map 58, Parcel 37B To Whom It May Concern: At the request of John Frizzell, we have examined our records with respect to the parcel or parcels of land in the County of Albemarle, Virginia referenced as 556 Dettor Road, Ivy Industrial Park, Ivy, VA and owner listed as Virginia Land Holdings, LLC. The Property is more particularly shown on that certain survey entitled " that certain tract of land in Albemarle County, near Ivy, containing 10 acres, shown as Tract -1 on plat recorded in the Clerk's Office of the Circuit Court of Albemarle County, Virginia in Deed Book 488, page dated May 19, 1971, prepared by William S. Roudabush, Jr., Certified Land Surveyor, (the "Property"). We provide the following information: The Property is zoned LI under the zoning ordinance of the County of Albemarle, Virginia. The LI zoning district permits "Engineering, engineering design, assembly and fabrication of machinery and components, including such on-site accessory uses as machining, babbitting, welding and sheet metal work and excluding such uses as drop hammering and foundry" as a matter of right without the necessity of obtaining a conditional or special use permit, variance or special exception. 2. The Property was rezoned to Light Industry- LI when the current Zoning Ordinance was adopted on December 10, 1980. The property is not subject to proffers or other special limitations or conditions as a result of the rezoning. 3. The property is developed in accord, with one exception, with a site plan most recently amended on June 22, 2005 by a letter of revision. The property will be in compliance with the site plan when the dumpster pads are installed. This will abate the Site Plan Violation #2005-123. A copy of the chronology of the violation is enclosed. The site plan is a ALTA/ACSM Title Survey by Roudabush, Gales and Associates, dated March 15, 2005 and revised on April 19, 2005 C:\inetpub\wwwroot\cityviewlazerfiche_integration\tempdocholder\13962.doc Directed Vapor Technologies International, Inc. October 4, 2005 Page 2 4. The Property contains no other zoning violations apart from the above referenced site plan violation. 5. The Property is recognized as one separate parcel of land under the Zoning Ordinance of the County of Albemarle, Virginia, may be conveyed, leased, or mortgaged as one or more separate parcels without violating any requirements of the zoning or subdivision ordinances of the County of Albemarle, Virginia, and currently complies with such subdivision ordinance and other applicable subdivision laws. The Property is not subject to any conditions or special limitations imposed by the County of Albemarle, Virginia in connection with any subdivision approval of the Property. 6. I understand that the proposed uses include: welding of machinery and machinery components; self-contained coating of metal parts with no emissions or effluent other than cooling water. This use is generally consistent with Section 27.2.1 (10), "Engineering, engineering design, assembly and fabrication of machinery and components, including such on-site accessory uses as machining, babbitting, welding and sheet metal work and excluding such uses as drop hammering and foundry" as a matter of right. However, prior to the commencement of this use the owner must obtain a zoning compliance clearance. As a condition of approval of the clearance the owner must submit a certified engineer's report describing the proposed operation as described in Section 4.14. The requirements for a zoning compliance clearance are set forth in Section 31.2.3.2. Copies of these two sections are enclosed. 7. The Property and the current uses thereof comply with current applicable zoning, subdivision, development, building and use laws, ordinances, codes, rules, regulations and other similar restrictions (including, without limitation, all requirements and restrictions of the zoning ordinance of the County with respect to height, floor space area, density, set backs and parking). Accordingly, the Property is a legal conforming use. 8. The current location of the improvements on the Property complies with all building setback lines and height and other zoning requirements specified for LI zoning classification. 9. In the event of casualty, the improvements located on the Property, if any, may be reconstructed to their current location and dimensions. 10. Permanent, unconditional certificate(s) of occupancy have been issued and are in effect for all space on the Property, and the County is not aware of any circumstances which would render the certificate(s) of occupancy invalid or cause it/them to be revoked. A copy of a list of Certificates of Occupancy that have been issued for the property is enclosed. The certificates of occupancy that were originally issued for the Property are still in force and effect. A Zoning Compliance Clearance, as described above, will be required prior to commencement of the proposed use. 12. The Property does not contain any improvements or real estate located in the 100 Year Flood Plain as shown in the Flood Boundary and Floodway Maps prepared by the Federal Insurance Administration of the United States Department of Housing and Urban Development.
