Dear Mr. McVeigh:
This certification regarding the zoning and subdivision status of the above -referenced
Property is provided to General Electric Capital Assurance Company at the request of
the above -referenced Owner.
The Project cited above was approved by the County of Albemarle as follows:
• TMP 06000-00-00-045A2: 5.146 acres, Six Multi -family structures, 127 units,
Phase II Ivy Gardens; Site Plan dated October 13, 1972, Rev. September 28,
1973 (SDP -198) the project was built in 1971-1973.
• TMP 06000-00-00- 045AO: 6.58 acres, six multifamily structures, 152 units,
phase III Ivy Gardens ; Site Plan approved by Planning Commission on
September 17, 1973 (SDP -198), last revised May 28, 1981 (SDP -80-009) the
project was built in 1980.
The zoning code affecting the Property is the Zoning Ordinance of the County of
Albemarle, Virginia. The Property is Zoned PRD (Planned Residential Development).
The property is in the Airport Protection Overlay District and the Entrance Corridor
Overlay District (EC). PRD zoning allows multi -family units, including garden apartments
by -right. The 127 unit apartment complex (phase II) requires 214 parking spaces.

According to (SDP -198) dated October 1968, the available number of parking spaces
for Phase II of the Project is 221. Phase II of the project has sufficient parking.
The 152 unit apartment complex (phase III) requires 264 parking spaces. According to
(SDP -198) dated October 1968, the available number of parking spaces for Phase III of
the Project is 245. The parking available for phase III is legally non -conforming having
been constructed before December 10, 1980, the month, day, and year the current
ordinance was adopted.
The Property and its use as a 279 unit apartment complex complies with the ordinances
of the County of Albemarle, including the Zoning Ordinance, and all applicable county
building and use restrictions. The Community Development Department has received
no notice of any activity or use on this property that would violate the Zoning Ordinance.
There are no variances, conditional use permits or special use permits required for the
existing improvements as constructed on the Property or their use.
The Property is a legally non -conforming use under the Zoning Ordinance of the County
of Albemarle, Virginia.
Each parcel comprising the Property complies with all applicable subdivision and
platting ordinances, rules and regulations and can be conveyed without the filing of a
plat or replat of any portion of the Property. This site was inspected for zoning
compliance on 11/14/2005. No violations were identified.
