This letter is based on a review of our records and an inspection of the site. 1. The property is zoned Commercial- C-1. 2. The property is in the Airport Protection Overlay District -AIA. 3. The parcels abutting the property are zoned Residential- R-1 & R-10, commercial- C-1 and Highway Commercial -HC. 4. This is not a Planned Unit Development. 5. On July 10, 1984 the Board of Zoning Appeals approved VA -84-48. This variance allowed a freestanding sign to be located 10 feet from the right of way of Route 754, a variance of 20 feet. 6. There are no legal nonconforming issues associated with this site. 7. This project was built under a site development plan originally approved on July 21, 1988. The site plan was most recently revised on July 15, 1993. The plan C:\inetpub\wwwroot\cityviewlazerfiche_integration\tempdocholder\13968.doc LaKisha Ellis May 17, 2005 Page 2 shows a 30,000- square foot office building, requiring 112 parking spaces and served by 113 parking spaces. The parking requirement was based on 1 space per 200 square feet of net floor area, calculated at 75% rather than 80% of gross floor area. 8. A zoning clearance was issued to a former owner of the property, County West L.P., on October 10, 1980. A new clearance is required when a use is changed or intensified or when the occupant of a use changes. A clearance application is enclosed. We ask that the owner(s) for each business operating in the building to complete and sign the form. The fee for this is waived. A review of our records does not show any other unresolved zoning or building code violations and /or complaints. 9. The property was inspected for zoning on May 16, 2005. It was found to be in compliance with the zoning ordinance and in accord with the site development plan that was approved on July 15, 1993. 10. The original Certificate of Occupancy was issued on May 22, 1985. It is the policy of this department to purge building permit files after three years. Copies of Certificates of Occupancy are maintained on microfilm. Therefore, we have not retained any copies of Certificates of Occupancy associated with this project. Furthermore, the absence of a Certificate of Occupancy for the project will not give rise to any enforcement action. You may obtain copies of Certificates of Occupancy associated with this building for an additional fee of $25.00 each. Please contact me if you have questions or require further information.
