Dear Ms. Smith:
In response to your request for a Letter of Zoning Compliance for the above referenced
Property, please be advised of the following:
• The Property is zoned HC, Highway Commercial subject to ZMA 1985 -00017 and
ZMA1995 -00007 and are in the EC, Entrance Corridor Overlay District and the AIA,
Airport Impact Overlay District (See attachment)
• The Property is developed with service and retail stores and a daycare. Such uses are
permitted by -right in the HC district.
• This Property is subject to SP- 2012 -00022 approved 09/11/2012 for an off -site sign and
SP- 2007 -00056 approved 06/11/2008 for a drive -thru. (See attachment)
• This Property is subject to the Site Development Plan, SDP2008 -00090 that was
approved on January 14, 2010. A site inspection was completed and revealed no
inconsistencies with the approved site plan.
• All surrounding properties are also zoned HC, Highway Commercial.
• This office has record of an open zoning violation regarding temporary signs for the
daycare on this parcel. The site is in the process of establishing a freestanding sign and
the temporary sign should be removed within week.
• All current occupants have a zoning clearance and certificate of occupancy. Copies of
site plans and certificates of occupancy can be obtained from this office with a request
through the department's Records Manager, Ester Grace, 434 - 296 -5832 ext. 3823.

Dear Dr. Hurt:
The Albemarle County Board of Supervisors, at its meeting of December
19, 1985, by a vote of 5 -1, approved the above noted petition with the
proffer submitted by you to.this department on October 17, 1985 as
amended at the meeting of December 18, 1985.
At that meeting you verbally agreed to the following proffer:
"I am the owner of Parcel 93A, Tax Map 45, which is presently
zoned highway commercial in entirety. As contract purchaser of
Parcels 109A and 109 and 109B, Tax Map 45, with combined acreage
of 27.3 acres, I would like the County to change the zoning on the
back portions of Parcels 109A and 109 from residential to highway
commercial so that they will all have the same depth of
commercial zoning.
�I will limit the access on Parcel(s) 109, 109A, 109B, and 93A to
no more than three (3) total entrances. I will limit the
development on these parcels so that -they will not generate any
more traffic than they are presently zoned for."
For your future reference, this department has calculated that this
proffer will limit the total traffic generation on Parcels 109 and
109A to no more than (4,& O--)vehicles per day.
If you have no questions as to the wording of this proffer and agree
as to its contents, please sign below and return the original to this
office as soon as possible.

usually measures the level of service for all turning movements. In addition
the applicants would be required to do whatever is necessary for turn lanes,
signalization, etc., if their project lowers the level of service. Mrs.
Thomas said that is not clear to her in reading the proffers. Mr. Cilimberg
said it is their understanding.
Mr. Bowerman said the rationale is the same of making sure that the
intersection and the highway can handle the traffic that is going to be
generated by that development at its ultimate development. He is comfortable
with the way this is presented; the applicants will have to make the intersec-
tions work for their project.
Mr. Davis said he is also comfortable with the proffers. It clearly
states that the result cannot lower the level of service. The applicants
would make improvements to mitigate that result or not develop.
Mr. Cilimberg said the Planning Commission, at its meeting on November
14, 1995, unanimously recommended approval of ZMA- 95 -07, subject to acceptance
of the applicant's proffers.
The Chairman opened the public hearing.
Mr. Jim Hill was present to represent the applicant. The applicants
have been working with the staff for five years on this piece of property. He
also does not quite understand everything, but according to the attorneys, it
is fair to everybody involved in the development of the land and the road
system. He will answer any questions from the Board. He added that staff has
been great in working on this project.
There being no other public comments, the public hearing was closed.
Motion was offered by Mr. Bowerman, seconded by Mr. Marshall, to approve
ZMA -95 -07 subject to acceptance of the applicant's proffers. Roll was called
and the motion carried by the following recorded vote:
AYES: Mrs. Thomas, Mr. Bowerman, Mrs. Humphris, Mr. Marshall, Mr. Martin and
Mr. Perkins.
NAYS: None.

On June 11, 2008, the Albemarle County Board of Supervisors took action on SP # 2007-
00056, Rivanna Plaza to allow a drive thru lane for proposed retail building on Tax Map 45,
Parcel 109, 1412C in the Rio District. This special use permit was approved based on the
following conditions:
1. Drive -in window is limited to one window; and
2. Development of the site will be in general accord with the site plan titled Special Use
Permit Application Plan for Rivanna Plaza and initialed and dated April 12, 2008.
Please be advised that although the Albemarle County Board of Supervisors took action
on the project noted above, no uses on the property as approved above may lawfully
begin until all applicable approvals have been received and conditions have been met.
This includes:
compliance with conditions of the SPECIAL USE PERMIT;
approval of and compliance with a SITE PLAN; and
approval of a ZONING COMPLIANCE CLEARANCE.
In the event that the use, structure or activity for which this special use permit is issued is not
commenced within twenty -four (24) months from the date of Board approval, it shall be deemed
abandoned and the permit terminated. The term "commenced" means "construction of any
structure necessary to the use of the permit."

At their meeting on September 11, 2012, the Board of Zoning Appeals voted 5 -0 to issue a special
use permit for this off -site sign in accordance with the Albemarle County Zoning Ordinance, subject to
the following conditions:
1. The off -site sign shall not exceed 32 square feet in sign area.
2. The permit number for the special use permit shall be affixed to the sign in a conspicuous
place as required by Section 4.15.5 of the Zoning Ordinance.
3. The permitted sign must contain the name of the occupant(s) of parcel 04500- 00- 00- 112C0.
