You have asked for a letter that provides an analysis of the zoning and other information
regarding the referenced property, located at the corner of Hydraulic Road and Arbor
Crest Drive in Charlottesville, VA. This letter is based on a review of our records and an
inspection of the site.
1. The property is zoned R-15, Residential.
2. This project was originally approved for 66 units by the Planning Commission on
October 21, 1981 under SDP 1981-044. The Commission approved an overall
density of 18.34 dwelling units per acre based on bonus factors for providing
landscaping and preserving a natural area. The Board of Supervisors rezoned
Parcel 39B, containing 0.33 acres from R-2 to R-15 under ZMA-96-11. This
parcel was later combined with Parcel 39. The most recent amendment to the site
plan, SDP 1999-155, was approved on February 29, 2000. This amendment added
4 dwelling units for a total of 70 units. The site improvements, including the
parking, were inspected for zoning compliance on December 6, 2004. No
violations were identified on the site on that date.
3. There are no legal nonconforming issues associated with this site.

4. A review of our records does not show any unresolved zoning or building code
violations and /or complaints.
5. Our microfilm records show that the 6 residential buildings received Certificates
of Occupancy on February 21, 1984. The additional 4 units approved by SDP
1999-155 received Certificates of Occupancy on December 12, 2000, January 23,
2001 and two issued on May 16, 2001. It is the policy of this department to purge
building permit files after three years. Copies of Certificates of Occupancy are
maintained on microfilm. Therefore, we have not retained any copies of
Certificates of Occupancy associated with this project. Furthermore, the absence
of a Certificate of Occupancy for the project will not give rise to any enforcement
action. Please be aware that interior renovation that does not involve a change of
use does not require a Certificate of Occupancy. You may obtain a copy of a
Certificate of Occupancy for an additional fee of $25.00 each.
