RE: Tax Map 61 Parcel 124 (the "Property") -Arden Place off of Rio Road East
Ladies and Gentlemen:
At the request of Elaine H. Rush at Williams Mullen, we have examined our records
with respect to that certain land and proposed improvements thereon located in
Albemarle County, Virginia, identified as Tax ID No. 06100-00-00-12400 (the
"Property"), and we are pleased to advise you that:
The Property is currently zoned R-15, Residential, which allows up to 15
dwelling units per acre without density bonuses. The Property consists of
11.35 acres according to the County's records. The proposed use of a 212
unit apartment complex on the 11.35 acre parcel, which Arden Place
Associates, LLC is purchasing for the development, is allowed by right in the
R-15 zoning district as a result of the density bonuses which have been
applied and approved. There is no necessity of obtaining a conditional or
special use permit, variance, special exception or other authorization or
approval to use the Property as described here. There are no pending
applications to amend the zoning of the Property or for any special use permit
or variance.
The Property is not subject to any proffered conditions, plan of development
or other special limitations imposed by the County of Albemarle, Virginia in
connection with the zoning of the Property.
The Property is located within the Entrance Corridor Overlay District (EC) and
construction is subject to review by the Architectural Review Board.

■ The Property is located within the Airport Impact Area Overlay District (AIA)
A preliminary site plan, SDP -2009-9, was approved on September 8, 2009 to
allow 212 multifamily residential apartment units and a club house on 11.35
acres of the Property. The final site plan, SDP2009-91 was approved March
1, 2010 for the same. A minor amendment to the site plan, SDP2010-042
was approved August 6, 2010. If the improvements on the Property are
constructed substantially in accordance with the conditions of the approved
site development plans, the improvements will be in compliance with all
applicable zoning regulations of the County of Albemarle, Virginia.
A final subdivision plat, SUB -2009-70, was approved August 26, 2010 to
divide out the 11.35 acre site for the Arden Place apartments. The property is
recognized as one separate parcel of land under the subdivision ordinance of
the County of Albemarle, Virginia and may be conveyed, leased, or
mortgaged as one separate parcel without (a) violating any requirements of
the zoning or subdivision ordinances of the County of Albemarle, Virginia, or
(b) requiring any further subdivision approvals from the County of Albemarle,
Virginia beyond the one pending. The Property currently complies and will
comply with such subdivision ordinances and other applicable subdivision
laws. The Property is not subject to any conditions or special limitations
imposed by the County of Albemarle, Virginia in connection with any
subdivision approval of the Property.
■ Drawings and Specifications for the above -captioned project have been
examined and will conform to all applicable provisions of the zoning laws and
regulations of Albemarle County
The Property is currently a vacant parcel. To the best of my knowledge, the
proposed use of the Property as described herein complies or will comply with
all applicable requirements of the zoning ordinance of the County of
Albemarle, Virginia. There are no current or active violations, fees due, or
proceedings to challenge the zoning or approvals of the Property pending.
