Re: Zoning Verification for MD Development LLC property known as
TMP 61-124B — Rio East Phase II
Dear Sir or Madam:
The above -referenced parcel is zoned Planned Development — Mixed Commercial (PD -MC),
ZMA-1996-004 & ZMA-2003-11. This property is currently undeveloped, but construction has
begun. If it is constructed in accord with the site plan named in the next paragraph, it will be in
compliance with the County of Albemarle zoning regulations with regard to the multi -unit, mixed
use development (medical and office buildings) and the parking lot on the subject parcel. The office
buildings and their accessory parking are both by -right uses in this zoning district.
The proposed use of multiple multi -use units as noted on the approved site plan for the
property dated 08/19/04, entitled "Final Site Development Plans for Rio East Phase II, Rio District,
Albemarle County" is generally in compliance with the ordinance per the information as described
on this plan. The height of one story (less than 35 feet), the number of units proposed (2) and the
number of parking spaces (87) meet the requirements of the Albemarle County Zoning Ordinance
for this zoning district.
