Dear Ms. Ellis:
You have asked for a letter that provides an analysis of the zoning and other information
regarding the referenced property. This letter is based on a review of our records and an
inspection of the site.
1. The property is zoned Planned Development -Mixed Commercial- PDMC.
2. The property is in the Airport Protection Overlay District.
3. The parcels abutting the property are zoned Planned Residential Development -
PRD and Highway Commercial- HC.
4. This is not a Planned Unit Development.
5. The zoning of this property was established by Zoning Map Amendment ZMA-
96-04. The property is subject to the proffers of that action. A copy of the proffers
is attached. The proffers permits all uses allowed by right in Section 23.2.1 which
include administrative and business offices. This action superceded ZMA-84-6
which rezoned a portion of the original parcel from R-10 to CO.

6. There are no legal nonconforming issues associated with this site.
7. This project was built under a site development plan approved on October 3,
1996. The plan shows an 8,625 square foot office building served with 66 parking
spaces. This use is permitted by right in this district pursuant to ZMA-1996-04.
8. A review of our records does not show any unresolved zoning or building code
violations and /or complaints.
9. The property was inspected for zoning on May 11, 2005. Three issues were
identified. Apart from the three issues identified below, the site was found to be in
compliance with the zoning ordinance and in accord with the site development
plan that was approved on October 3, 1996.
A willow oak located near the southwest corner of the property is dead
and must be replaced. Also, five viburnam along the northeast side of the
property next to Rio East Court are either dead or missing and must be
replaced.
The wall pack light mounted on the north side of the building may not
comply with the lighting regulations adopted on August 12, 1998.
However, if it was mounted prior to the adoption of the ordinance or if it
qualifies as security lighting it is exempt from the regulations.
While zoning compliance clearances have been issued for temporary
events on this site, no clearance was issued for the office use of the
building. A new clearance is required when a use is changed or intensified
or when the occupant of a use changes. A clearance application is
enclosed. We ask that the owner of the business operating in the building
complete and sign the form. The above mentioned landscaping and
lighting issues must be addressed as a condition of approval of the
clearance. The fee for this is waived.
10. A review of our records does not show any other unresolved zoning or building
code violations and /or complaints, apart from the three items identified in #9.
11. The original Certificate of Occupancy was issued on May 19, 1997. It is the
policy of this department to purge building permit files after three years. Copies
of Certificates of Occupancy are maintained on microfilm. Therefore, we have not
retained any copies of Certificates of Occupancy associated with this project. The
absence of a Certificate of Occupancy for the project will not give rise to any

enforcement action. You may obtain copies of Certificates of Occupancy
associated with this building for an additional fee of $25.00 each.
