Box 500 Richmond, VA 23218-0500 United Bank 1265 Seminole Trail Charlottesville, VA 22901 RE: LZC2010-015 — Treesdale Park —AHIP — ZMA2004-00022 620/640 Rio Road E, Charlottesville, Virginia 22901, Albemarle County, VA Tax Map/Parcel #s 61-182, 61-183, & 61-183A, Albemarle County, VA (the "Property") Dear Ms. Childress: In response to your Application for a Letter of Zoning Compliance filed with this office on August 18, 2010, please be advised as follows: The property is zoned Planned Residential Development (PRD) under the Zoning Ordinance of the County of Albemarle, Virginia, which permits the use of the Property for an apartment complex of 88 dwelling units, with appurtenant parking, as a matter if right. This is in accordance with the proffered conditions of rezoning Case No. ZMA2004-00022 (a copy of which is attached) approved on December 12, 2007 along with variations approved as part of the preliminary site plan review for SDP2008-119, approved December 12, 2009. The Final site plan, SDP2010-013, is pending final signatures. ■ To the best of my knowledge, the property is not in violation of any proffered conditions or other special conditions or limitations imposed by the County of ■ The property will meet all access and parking requirements required by the Albemarle County zoning ordinance and will be in compliance with the current zoning ordinance of Albemarle County, including all provisions regulating setback, density and building heights, if developed in accordance with the final site plan, SDP2010-013, once approved. ■ The property is recognized as one or more separate parcels of land and may be conveyed, leased or mortgaged as a separate parcel. The Property is not subject to any other conditions or special limitations imposed by the County of Albemarle in connection with any subdivision approval of the Property. To the best of my knowledge, as of this date, there are no current or pending zoning or building code violations against the property.
