Dear Mr. Waller:
The Albemarle County Planning Commission, at its meeting on March 18, 2014, by a vote of 7:0,
recommended approval of the above -noted petition to the Board of Supervisors.
Please note that this recommendation is subject to the following condition:
1. Development and use shall be in general accord with what is described in the applicant's request
and site plans, entitled "Hydraulic Road ", with a final zoning drawing submittal date of 11/3/13
(hereafter "Conceptual Plan "), as determined by the Director of Planning and Zoning
Administrator. To be in accord with the Conceptual Plan, development and use shall reflect the
design of the development as shown on the Conceptual Plan.
Minor modifications to the plan which do not conflict with the elements above may be made to
ensure compliance with the Zoning Ordinance.
In addition, the Planning Commission recommended approval of the Modifications from Section
5.1.40(c)(3)(i) for the size and total number of arrays, as follows,
- total number of arrays shall not exceed 3 (applicant proposes 5 arrays), and
- size shall not exceed the sizes stated by the applicant (applicant states the sizes will be 1176,
1194 and 1237 square inches).
Within 30 days of the date of this letter, please do one of the following:
(1) Resubmit in response to Planning Commission recommendations
(2) Request indefinite deferral
(3) Request that your Board of Supervisors public hearing date be set
(4) Withdraw your application

Dear Mr. Waller:
On May 7, 2014, the Albemarle County Board of Supervisors took action on the above noted petition to install two (2)
additional arrays each containing 3 flush mounted antennas on an existing 140 foot monopole and install associated
equipment. This special use permit in the Jack Jouett Magisterial District was approved subject to the following condition:
Development and use shall be in general accord with what is described in the applicant's request and site plans,
entitled "Hydraulic Road ", with a final zoning drawing submittal date of 11/3/13 (hereafter "Conceptual Plan "), as
determined by the Director of Planning and Zoning Administrator. To be in accord with the Conceptual Plan,
development and use shall reflect the design of the development as shown on the Conceptual Plan.
Minor modifications to the plan which do not conflict with the elements above may be made to ensure compliance
with the Zoning Ordinance.
In addition, Special Exception for modifications from Section 5.1.40(c)(3)(i) for the size and total number of arrays was
approved subject to the following conditions:
Total number of arrays shall not exceed five (5), and
Size shall not exceed the sizes stated by the applicant (applicant states the sizes will be 1176, 1194 and 1237
square inches).
Please be advised that although the Albemarle County Board of Supervisors took action on the project noted
above, no uses on the property as approved above may lawfully begin until all applicable approvals have been
received and conditions have been met. This includes:
• compliance with conditions of the SPECIAL USE PERMIT;
• approval of and compliance with a SITE PLAN; and
• approval of a ZONING COMPLIANCE CLEARANCE.
