LeClair Ryan 123 East Main Street, 8t" Floor Charlottesville, VA 22902 RE: Tax Map 76, Parcels 44 and 44A Eagle's Landing Apartments Dear Ms. Albano: You have asked for a letter that provides an analysis of the zoning and other information regarding the referenced property. This letter is based on a review of our records and an inspection of the site. The above referenced parcels are zoned Residential -R15. This zoning district permits the 280 unit multi -family residential development with supporting amenities and infrastructure as shown on the final site development plan, SDP - 2002 -59. This plan was approved administratively on September 30, 2002. You have a copy of this plan. 2. A minor amendment of the site plan, SDP -2003-016, was approved administratively on July 30, 2003. This plan revised parking lot and swimming pool lighting. You have a copy of this plan. 3. On August 26, 2003 a Letter of Revision was approved administratively. This revision adjusted the phasing plan for bonding and occupancy purposes. A copy of the letter is attached. 4. On April 1, 2004 a Letter of Revision was approved administratively. Catherine Albano, Esq. July 13, 2003 Page 2 5. On July 26, 2002 a plat showing a boundary line adjustment, SUB -2002-191, was approved administratively. The plat conveyed 0.62376 acres from Parcel T.M. 76-46 to T.M. 76-44A. A copy of the plat is enclosed. 6. All required certificates of occupancy for this property have been issued. Copies for Buildings 1 -10, the swimming pool, the swimming pool maintenance building, the clubhouse and a modification are enclosed. 7. In the event of casualty to the project, in whole or in part, the project will be permitted to be rebuilt in accord with the approved site plan SDP -2002-059 as amended. 8. There are no legal nonconforming issues associated with this site. 9. There are no zoning or building code violations or complaints associated the property. 10. There are no proffers which affect the property. 11. The property was inspected on July 7, 2005. The site was found to be in compliance with the approved site plan as amended.
