This certification is provided for the benefit of Neighborhood Investments -UP,
LLC and its lender(s), including Union Bank and Trust, regarding the zoning,
subdivision and regulatory compliance status of the above - referenced property at
the request of Neighborhood Investments -UP, LLC.
(a) The Property referenced above, and as described in the legal description
you provided, is zoned Residential, R -15. Multifamily dwellings are
permitted by -right in this district. The Property is also in the EC,
Entrance Corridor Overlay District.
(b) The Property is a multi - family dwelling development with accessory
uses, including a club house, leasing office, mail kiosk and bus shelter.
SDP2001 -129 shows a 144 unit residential development served by 661
parking spaces (660 of which are required), including 13 handicap
spaces. The parking requirement of 1.25 spaces per bedroom applied at

(c) The Property and its use comply with the ordinances of the County of
Albemarle, including the Zoning Ordinance. The Property conforms to
the existing approved site plan and there is no further site plan approval
pending relating to the Property. Certificates of Occupancy were issued;
however, these are available only on microfilm. Copies may be obtained

(d) There are no variances, proffers, or special use permits existing for the
Property.
(e) The Property, including parking, is a conforming use under the Zoning
Ordinance.
