Greenfield Pierce Atwood LLP Merrill's Wharf 254 Commercial Street Portland, ME 04101 Re: Albemarle County Tax Map Parcel 76 -55C Ladies and Gentlemen: At the request of Williams Mullen, we have examined our records with respect to that certain parcel of real property located in Albemarle County, Virginia described as follows: that certain proposed parcel of land containing 2.73 acres, having a street address of 1200 5`" Street; Charlottesville, Virginia, and identified on the current tax maps of Albemarle County, Virginia as tax map parcel 76 -55C (hereinafter, the "Property"), As the Deputy Zoning Administrator for Albemarle County, I hereby certify the following information: 1. The Property is zoned Highway Commercial ( "HC ") under the zoning ordinance for Albemarle County (the "County "). The HC zoning district permits the use of the Property as a hotel (the "Existing Use ") as a matter of right without the necessity of obtaining a special use permit, special exception permit, variance, or other authorization or approval. 2. The Property is not subject to any proffered conditions, proffered plan of development, or other special limitations imposed by the County in connection with the zoning of the Property. Adjacent parcels (TMP76 -55A & TMP 76M1 -1) were required as part of their rezoning and special use permit approvals to use the existing entrance to the Property as a joint entrance. 3. The Existing Use of the Property is in compliance with the applicable requirements of the zoning ordinance of the County and applicable rules and regulations of the zoning district. Morris Creek Yacht Club, Inc. June 12, 2012 Page 2 4. The Property is developed in accord with site development plan SDP -173 that was approved on August 7, 1972. 5. A review of our files found no violations or alleged violations or regulations applicable to the Property, whether pending or having already occurred. 6. The Property is located in the Entrance Corridor (EC) Overlay District and the Airport Impact Area (AIA) Overlay District.
