A special use permit for the church (SP 2001-059) was approved by the Board of Supervisors on March 20, 2002. An amended special use permit (SP2004-026) was approved by the Board of Supervisors on October 13 2004. The amended special use permit was for the addition of an "accessory structure" on the church site for use to "store medical supplies, clothing, packaged food, etc. to be used for future mission trips and projects as well as storage for Calvary Baptist Church." ■ This Property has been developed as a church with approximately 13,100 square feet of total building, including the storage facility now used for the Mission Link food ministry. The use is served by 67 on-site parking spaces. This site has been developed in accord with SDP -2004-049 (Site Plan - Calvary Baptist Church) approved October 10, 2004. In reference to open violations, the Property was inspected for zoning compliance on February 10, 2011. While there appear to be no site plan violations on the Property, it does appear that the accessory building is I:\DEPT\Community Development\Zoning & Current Development\Determination of Compliance\2011 Compliance\LCZ- 201100001 Calvary Baptist Church.doc being used in a manner which was not covered by the amended special use permit referenced above. In particular, the "storage building" is now being use for offices, which is not a permitted use in the R-1 zoning. This use must cease immediately and the building shall only be used for the purposes called for in the approved special use permit. If the "offices" are, in fact, part of the church's use then they could be considered as accessory to the church, but separate office uses are not permitted. ■ Also, you indicate in your letter of January 2, 2011 that modifications were made to the building interior to "include offices" and that the building "does not include any restroom or running water capabilities". I am copying this letter to the Building Official, Mr. Jay Schlothauer, for him to determine if there are building code issues that must be addressed.
