Dear Ms. Quebral:
In response to your request for a Letter of Zoning Compliance for the above referenced
Property, please be advised of the following:
• The Property is located within the County of Albemarle and is designated as Tax Map
Parcel 09900- 00- 00 -049A0
• The Property is zoned RA, Rural Areas.
• The Property is subject to the following SP1982 -00009 and subject to its conditions and
the conditions of subsequent permits, SP1990- 00061, SP1991- 00047, SP2001 -00034
and SP2009 -00028 and by the Supplemental Regulations for Sawmill, Temporary or
Permanent found in Section 5.1.15. Approval letters and the supplemental regulations
are attached.
o The plat referenced in condition #2 of SP2009 -00028 was recorded in Deed Book
3924 Pages 334 -341 with the Clerk of the Circuit Court of Albemarle County
Virginia. This plat is missing the required signature from the Agent for the Board
of Supervisors of Albemarle County required per Section 14 -230C of the
Subdivision Ordinance. This being the case it has been determined that the
condition #2 is not being complied with. To comply with this condition a new plat
must be presented to the Department of Community Development and signed by
the Agent for the Board of Supervisors, then recorded with the Clerk of the Circuit
Court of Albemarle County Virginia.
• Condition #1 from SP1982 -00009 has permitted the "STORAGE BUILDING" parallel with
Route 712, Plank Road and the "METAL BUILDING W/ BASEMENT" to be closer to the
property lines than the 100 feet required with supplemental regulations of Section 5.1.15.
(See "Attachment C with SP1991- 00047) These two building were in existence for the
approval of SP1982- 00009.
• Currently the Property is not subject to pending applications for zoning map amendments
(re- zonings), special use permits or variances.

The zoning ordinance requires a zoning clearance in the following circumstances:
0 1. New use. Prior to establishing a new non - residential, other than an
agricultural, use.
0 2. Change or intensification of existing use. Prior to changing or intensifying an
existing non - residential, other than an agricultural, use.
0 3. Change of occupant. Prior to a new occupant taking possession of an existing
non residential, other than an agricultural, use.
This means that if the site is being used by company "A" as a sawmill and they leave and
company "B" takes over in then "B" must obtain a new zoning clearance.
The zoning clearance is not required for an entity to purchase the property, only to use
the property for a permitted use.
No other permits are required to purchase the property. If internal building improvements
are proposed then the appropriate building permits are needed. Any building additions
would be required to amend the special use permit, possible site plan approvals and
building permits.
This office has no record of any open zoning violations for the Property. A site inspection
of the Property revealed no violations.

The Albemarle County Board of Supervisors, at its meeting on "lay 19, 1982, voted
to approve your above - referenced special use permit request, subject to the following
conditions:
1. Compliance with Section 5.1.IS of the Zoning Ordinance except as modified or
waived below:
a. Section 5.1.15(a) shall not apply to existing development of the property;
provided that any building or storage area currently within 100 feet of a
property lire shall not be expanded or extended in the direction of the
property line. Buildings and storage areas which are in conformance -with
Section 5.1.15(a) shall remain in conformance with that section.
b. Section 5.1.15(b) shall not apply to existing development of the property;
provided that any machinery or building housing such machinery currently
within 600 feet to any dwelling on other property in the area shall not be
expanded or relocated in the direction of such dwelling. '-Iachinery and
buildings housing machinery, which are in conformance with Section S.1.15(b),
shall remain in conformance with that section;
c. No sawing, planing, chipping or operation of other processing machinery
(except the boiler plant and drying kiln) shall occur between 7 p.m, and
7 a.m. No loading /unloading of wood /wood products shall occur between
9 p.m. and 6 a.m.;
d. Noise measured at the closest dwelling shall not exceed current levels.
The applicant shall submit a certified engineer's report to the County
Engineer which shall specify current noise levels during normal operation
of the milling plant.

2. Compliance with Fire Official recommendations, dated `larch 30, 1982;
3. Approval is for addition of drying kiln and boiler plant only. Any other
additional uses such as the proposed cut -up plant and planer shed shall require
amendment of this petition;
4. Compliance with State Air Pollution Control Board and Environmental Protection
Agency standards for wood -fired boiler;
3. Dedication of twenty -five (25) feet from the centerline of Route 712;
6. These conditions shall be met prior to issuance of a building permit for the
drying kiln or boiler plant.

Dear Mr. Carr:
The Albemarle County Board of Supervisors, at its meeting on November 6,
1991, approved the above -noted request to amend SP -82 -09 which permitted a
sawmill. Request is to locate a planer and a building to house the planer on
20.6 acres zoned Rural Areas. Property on the west side of Route 712
approximately 0.87 mile south of Route 692. Tax Map 99, Parcel 49A. Please
note the amended condition #3 reads as follows:
3. Approval is for addition of drying kiln, boiler plant and planer and
planer building only. Any other additional use such as the proposed
cut -up plant shall require amendment of this petition. Planer shall be
located as shown on sketch dated October 1, 1991 and initialled W.D.F.
(copy attached).
The Board also added a condition #7 as follows:
7. Planer shall not be located on site until clearing of vegetation to
achieve adequate sight distance has been performed.

Dear Mr. Passerell:
The Albemarle County Board of Supervisors, at its meeting on November 14, 2001, unanimously
approved the above -noted request. Please note that this approval is subject to the following conditions:
1. Conditions of approval for SP- 1982 -09, as amended by SP- 1990 -61 and SP- 1991 -47, shall apply-,
2. The subject storage shed shall be located on the property in general conformance with the sketch
plan entitled 'Augusta Lumber SP- 2001 -34," subject to standards within Section 5.1.15 of the
Albemarle Zoning Ordinance,
3. The subject storage shed shall be restricted to the following purposes:
a) storage of lumber-, and
b) sorting of lumber-,
4. No noise generating production equipment shall be used within the subject building.
In the event that the use. structure or activity for which this special use permit is issued shall not be
commenced within eighteen (18) months after the issuance of such permit, the same shall be deemed
abandoned and the authority granted thereunder shall thereupon terminate. For purposes of this section,
the term "commenced" shall be construed to include the commencement of construction of any structure
necessary to the use of such permit within two (2) years from the date of the issuance thereof which is
thereafter completed within one (1) year.

Dear Mr. Schooley:
On April 14, 2010, the Albemarle County Board of Supervisors took action on the above referenced
special use permit, amending SP200100034 on Tax Map 99 Parcels 49A and 49A3 in the Samuel Miller
District to include an existing lumber storage structure and on additional .267 acres. This special use
permit was approved based on the following conditions:
1. Approval of SP- 2009 -00028 is for the addition of one (1) three thousand, six hundred (3,600)
square foot lumber storage /sorting building only. Any other uses, buildings, and /or enlargement
of buildings shall require amendment of this special use permit;
2. The subject storage shed shall be located on the property in general accord with the sketch plan
entitled "Plat of Boundary Line Adjustment Tax Map 99 Parcels 49A and 49A3" dated September
25, 2008" (thereinafter the "Plat ") subject to standards within Section 5.1.15 of the Albemarle
Zoning Ordinance;
3. The subject storage shed shall be restricted to the following purposes:
a) storage of lumber and
b) sorting of lumber; and
4. No noise generating production equipment shall be used within the building proposed with
SP- 2009 - 00028, as shown in Attachment A, the "Plat" (yellow), or within 100' of the property line
of Tax Map 99 Parcel 49A3.
Please be advised that although the Albemarle County Board of Supervisors took action on the
project noted above, no uses on the property as approved above may lawfully begin until all
applicable approvals have been received and conditions have been met. This includes:
• compliance with conditions of the SPECIAL USE PERMIT;
• approval of and compliance with a SITE PLAN amendment; and
• approval of a ZONING COMPLIANCE CLEARANCE.
In the event that the use, structure or activity for which this special use permit is issued is not commenced
within twenty -four (24) months from the date of Board approval, it shall be deemed abandoned and the
permit terminated. The term "commenced" means "construction of any structure necessary to the use of
the permit."

D. Recommendation. Upon completion of its review, the site review committee shall
transmit to the agent its recommendation for approval if it determines that the plat satisfies the
requirements of subsections (A), (B) and (C), or its recommendation for required changes if it determines
the plat does not satisfy the requirements of subsections (A), (B) or (C).

Sec. 14 -228 Revisions to final plat to address required changes.
A final plat for which changes are required shall be revised as follows:
A. Requirements identified; letter to the subdivider. If the site review committee identifies
required changes to the final plat, the committee shall promptly issue a letter to the subdivider stating the
changes required to be made. The letter shall be sent by first class mail, be personally delivered or, if
consented to by the subdivider in writing, by fax or email.
B. Response to address requirements. The subdivider shall revise the plat to address all of
the required changes before approval of the final plat by the agent.

Sec. 14 -229 Deferral of review of final plat; when application deemed withdrawn.
The review of, and action on, a final plat may be deferred, and an application for a final plat may
be deemed withdrawn, as follows:
A. Request to defer by subdivider. A subdivider may request that review or action on its
application for a final plat be deferred for a specified period up to six (6) months. If during the deferral
period the subdivider does not request the agent to take action on the final plat as provided in section 14-
230 within six (6) months after the date the deferral was requested, the application shall be deemed to have
been voluntarily withdrawn.
B. Failure to submit revised plat. If a subdivider fails to submit a revised final plat to
address all of the requirements within six (6) months after the date of the letter from the agent as provided
in section 14 -228, the application shall be deemed to have been voluntarily withdrawn by the subdivider.
C. Extension of deferral period or period to submit revised plat. Before the deferral period
in subsection (A) expires, the subdivider may request that the agent extend the period before the application
is deemed to have been voluntarily withdrawn. The request must be received by the agent before the
deferral period expires. The agent may grant one extension for a period determined to be reasonable, taking
into consideration the size or nature of the proposed subdivision, the complexity of the review, and the laws
in effect at the time the extension request is made.

Sec. 14 -230 Review and action on final plat by agent.
The agent shall review and act on a final plat as follows:

ALBEMARLE COUNTY CODE
A. Review. The agent shall review the final plat for compliance with all requirements, and
shall make a good faith effort to identify all deficiencies, if any, during review of the plat. The agent shall
consider the recommendation of the site review committee as to whether the plat complies with all
applicable requirements and any statement by the subdivider. The agent also may consider any other
evidence pertaining to the plat's compliance with the requirements of this chapter as deemed necessary for
a proper review of the plat.
B. Time for action. The agent shall act on the final plat within sixty (60) days after the date
the plat was officially submitted, provided:
1. Alternative time for action if state agency approval is required. If approval of a
feature on the plat by a state agency is required, the agent shall approve or disapprove the plat within thirty-
five (35) days after receipt of approvals from all state agencies, and not more than ninety (90) days after the
date the plat was officially submitted.
2. Suspension of running of time for action. The running of the time by which the
agent must act on a plat shall be suspended: (i) from the date the appeal of a decision on a request for a
variation or exception is submitted under section 14 -203.1 until the date the planning commission or the
board of supervisors, as the case may be, acts on the appeal, whichever takes the final action; (ii) from the
date of the letter to the subdivider until the date the revised preliminary plat addressing the required
changes is submitted under section 14- 228(B); (iii) from the date of the subdivider's request for a deferral
under section 14- 229(A); and (iv) during any extension granted under section 14- 229(C).
C. Action to approve and notice of approval. If the agent determines that the final plat
complies with all applicable requirements, he shall approve and sign the plat, and may issue a letter to the
subdivider informing the subdivider of the approval. The agent shall mail the letter by first class mail,
personally deliver it to the subdivider, or, if consented to by the subdivider in writing, deliver it by fax or
email.
D. Action to disapprove and notice of disapproval. If the agent determines that the plat does
not comply with all applicable requirements, he shall disapprove the plat and promptly issue a letter to the
subdivider stating the reasons for disapproval by identifying the preliminary plat's deficiencies and citing
the applicable sections of this chapter or other law, and what corrections or modifications will permit
approval of the plat. The agent shall mail the letter by first class mail, personally deliver it to the
subdivider, or, if consented to by the subdivider in writing, deliver it by fax or email.
E. Submittal of corrected or modified plat. Any subdivider who has received a notice of
disapproval under subsection (D) may submit a corrected or modified final plat addressing the deficiencies
identified in the notice of disapproval, as follows:
1. Deadline.for submittal. The subdivider shall submit the corrected or modified
plat within sixty (60) days after the date of the notice of disapproval.
2. Time for action. The agent shall act on the corrected or modified plat within
forty-five (45) days after it was submitted.
3. Action to approve or disapprove. The agent shall approve or disapprove the
corrected or modified plat and provide notice of the action to the subdivider as provided under subsections
(C) and (D).
