Dear Mr. Mehlman:
You have asked for a letter that provides an analysis of the zoning and other information
regarding the referenced property. This letter is based on a review of our records and an
inspection of the site.
■ The property is zoned Commercial - C1. A portion of the property, not affecting the
condominium units themselves, is located in the Flood Hazard Overlay District — FH.
The Board of Supervisors approved a Special Use Permit, SP -1999-44, on September 8,
1999. This action allows the residential use consisting of a maximum of 143 apartment
units, club house, pool and associated parking in the commercial zoning district. As a
condition of approval of this permit, Tax Map 77, Parcel 41 was dedicated to the County
by the deed of record in Deed Book 2372, page 580. A copy of the approval letter is
enclosed.
■ This special use permit (SP -1999-44) runs with the land and is valid as long as the
property is used for the existing purposes, within the limits of the approved conditions. If
the property were to be destroyed the special use permit would continue to apply as long
as the replacement was in accord with the original approval.
• The property is developed in accord with the Site Development Plan, SDP -2000-97,
approved on January 31, 2001. The plan shows 125 dwelling units served by 224
parking spaces. The 60 units containing 1 bedroom require 90 spaces and the 65 units
containing 2 bedrooms require 130 spaces for a total of 220 parking spaces.
■ Staff approved a Minor Amendment, SDP -2001-71 on September 10, 2001. This
amendment divided the project into seven phases.
■ A Letter of Revision, dated January 16, 2002, allows light fixtures on 20 -foot poles in the
same locations as shown on the original plan.
■ Staff approved another Minor Amendment, SDP -2002-5 on March 20, 2002. This
amendment revised the landscaping plan to utilize the existing tree canopy and to
increase the landscaped areas around the buildings by reducing the sidewalks from 5
feet to 4 feet in width. The plan also showed the phase lines that were previously
approved.
■ The Board of Zoning Appeals approved a Special Use Permit, SP -2002-15, on May 7,
2002. This action allows an off-site sign, advertising Riverbend Apartments, to be
located on Tax Map 78, Parcel 17G2. The special use permit limits the aggregate area
of the on-site sign and the off-site sign to 32 square feet.
■ The property was inspected on November 15, 2010. The site was found to be in
compliance with zoning regulations.
