Tax Map/Parcel 07800-00-00-020131 (the "Property")
Dear Mr. Miller:
In response to your letter of July 8, 2010 requesting a letter of zoning compliance for
the Hilton Garden Hotel that has been constructed on the referenced parcel, please
be advised as follows:
The Property is currently zoned PD -MC, Planned Development -Mixed
Commercial and is proffered per ZMA 1996-003. The Property is also in the
EC, Entrance Corridor Overlay District.
Uses that are permitted by right in the C-1, CO and HC zoning districts are
permitted by right in the PD -MC district per § 25.2.1.1 of the Albemarle
County zoning ordinance. Hotels, motels and inns are permitted by right in
the Highway Commercial — HC zoning as per §24.2.1.20 of the ordinance.
Therefore, the hotel is permitted by right on the referenced site.
A site development plan (SDP -2005-030), showing a 124 room hotel with
restaurant and conference facility was, approved on August 10, 2005. The
project was built in accordance with that approved site plan and is complete
and complies with all zoning regulations. Specifically, the zoning ordinances
and amendments have not been violated with. respect to any of the following
matters:
i. Area, width, or depth of the Land as a building site for the structure

ii. Floor space area of the structure
iii. Setback of the structure from the property lines of the Land
iv. Height of the structure, or
V. Number of parking spaces
The required parking for this development is 159 spaces, which is met by the
147 spaces on the site along with shared parking on the adjoining lot. The
shared parking arrangement is necessary for the parking to be sufficient for
the project.
• All required permits, consents and authorizations were obtained when
required and a certificate of occupancy was issued upon completion of
construction. As of this date there are no current or pending zoning violations
against the Property.
