You have asked for a letter that provides an analysis of the zoning and other information
regarding the referenced property, located at the corner of Pantops Drive and Beverly
Drive in Charlottesville, VA. This letter is based on a review of our records and an
inspection of the site.
1. The property is zoned R-15, Residential.
2. This property is not located in any Overlay District.
3. The parcels abutting the property are zoned Highway Commercial- HC and
Planned Development Mixed Commercial- PDMC.
4. This is not a Planned Unit Development.
5. This project was originally approved under SDP 1998-091, signed on July 2,
1998. This plan was amended by SDP 1999-146, signed on November 12, 1999.
Condominium plat was approved under SUB 2005-035, signed on March 3, 2005.
The site improvements, including the parking, were inspected for zoning
compliance on February 3, 2005. No violations were identified on the site on that
date.

6. The Planning Commission on March 4, 1998 approved a critical slope, cross slope
parking grade, and curvilinear parking waiver requests. A copy of the approval
letter is enclosed.
7. In the event of casualty to the project, in whole or in part, the project will be
permitted to rebuild in accord with the approved site plan. If the ordinance is
changed in the future, the site could be rebuilt as in Section 6, Nonconformities.
8. There are no legal nonconforming issues associated with this site.
9. A review of our records does not show any unresolved zoning or building code
violations and /or complaints.
10. The property was inspected for zoning compliance on February 3, 2005. It was
found to be in compliance with the zoning ordinance and in accord with the site
development plan that was last revised on November 12, 1999.
11. Our records show all required Certificates of Occupancy for the parcel have been
issued. It is the policy of this department to purge building permit files after three
years. Copies of Certificates of Occupancy are maintained on microfilm.
Therefore, we have not retained any copies of Certificates of Occupancy
associated with this project. Furthermore, the absence of a Certificate of
Occupancy for the project will not give rise to any enforcement action. Please be
aware that interior renovation that does not involve a change of use does not
require a Certificate of Occupancy. You may obtain a copy of a Certificate of
