Dear Ms. Sanchez:
In response to your application for a letter of zoning compliance, this office has researched
the above referenced property and offers the following information:
1. The Property is zoned R-15 with proffers. This property is also located in the Entrance
Corridor Overlay (EC) and subject to the use limitations and regulations of those districts and
the Albemarle County Zoning Ordinance.
2. The Property is surrounded by Highway Commercial (HC) to the South, R-6 to the
North/North-East and R-1 to the West.
3. There is an outstanding Zoning Violation of a proffer on this site. ZNOV201100133 was
issued on August 16, 2011 in reference to Proffer E of ZMA 2000-10. Proffer E involves the
construction of a connector road to VDOT Mountainous Terrain Standards. The County
Engineer has determined this road to be unsafe and not to required standards. The ZNOV
gives Avemore until December 31, 2011 to repair the road.
4. The Property is subject to a rezoning (ZMA 2000-10) with proffers and a special permit (SP
2000-69) both of which were approved on June 20, 2001. Additionally, a Special Permit (SP
2000-70) was approved on November 20, 1991. Copies are attached.
5. The Property has an approved Final Site Development Plan (SDP 2002-138) dated December
17, 2003. Copies must be requested separately and are subject to certain fees.
6. The Property is not subject to a Planned Unit Development.

7. To the best of my knowledge, the Property is in compliance with all applicable zoning
ordinances, rules and regulations, including parking requirements, based on the final zoning
inspection(s) prior to occupancy.
This letter may be relied upon by the addressee(s) listed above and by any assignee or
successor in interest in the Property whether as owner or mortgagee. I am authorized and
empowered to execute this Zoning Compliance Letter on behalf of the County of Albemarle,
