Box 500 Corporation Limited, New York Richmond, VA 23218 -0500 Agency 1700 Broadway, 18th Floor New York, NY 10019 RE: Certification of Zoning — Keswick Hotel (the "Property ") Tax Map 80, Parcel 9, 701 Club Drive, Keswick, Albemarle County, Virginia Dear Mr. Davenport and Ms. Hee: You have asked for a letter that provides an analysis of the zoning and other information regarding the referenced property, located at the corner of Club Drive and Keswick Road in Keswick, VA. This letter is based on a review of our records and an inspection of the site. In response to that request dated September 23, 2010, please be advised of the following: 1. The property is located within the corporate limits of the County of Albemarle, Virginia. 2. The Property is zoned RA — Rural Areas and is subject only to the use restrictions generally applicable to that classification which are contained in the County of Albemarle Zoning Ordinance (the "Zoning Ordinance "). The use of the Property as a hotel is permitted by special use permit in that RA zoning classification as approved with SP2000 -033, approved by the Board of Supervisors on April 18, 2001. The latest Special Use Permit approval for this development was SP2008 -042, which was approved by the Board of Supervisors on February 4, 2009. This approval is good for 24 months prior to commencing the use, structure or activity for which the special use permit was granted. Enclosed are copies of the final approval letters of the actions on both special use permits. 3. Ingress and egress to and from the Property is to and from publicly dedicated roadways. 4. The proposed use of the property by its owner for continuation of its use as a hotel is a permitted use under Zoning Ordinance §10.2.2 #2, #4 & #27 as outlined in the approval letters for SP2000 -033 and SP2008 -042. 5. The current setbacks, measured from the property lines or right -of -way lines are: Front — 75 feet; Rear — 35 feet, and; Sides — 25 feet. The Property is in compliance with the Zoning Ordinance including, but not limited to all regulations regarding required setbacks as well as density, parking and height limits. 6. The Property has access to over 200 existing off - street parking spaces which is in excess of the required number of spaces. 7. No application for rezoning of the Property, or for a special use or conditional use permit or variance in connection with the Property, is now pending. 8. The Property is recognized as a separate parcel of land under the subdivision ordinance of the County of Albemarle. The Property may be conveyed, leased or mortgaged as a separate parcel and the Property currently complies with such subdivision ordinance and other applicable subdivision laws. 9. This department has no record of any past or pending unresolved building or zoning violations for this Property and the undersigned is unaware of any violations of the applicable portions of the Zoning Ordinance. 10. Our records show all required Certificates of Occupancy for the parcel have been issued. It is the policy of this department to purge building permit files after three years. Copies of Certificates of Occupancy are maintained on microfilm. Therefore, we have not retained any copies of Certificates of Occupancy associated with this project. Furthermore, the absence of a Certificate of Occupancy for the project will not give rise to any enforcement action. Please be aware that interior renovation that does not involve a change of use does not require a Certificate of Occupancy. 11. The department is not aware of any pending or threatened action by the County to acquire any portion of the Property through eminent domain. 12. The property was inspected in October of 2010.
