Caramanis of Scott Kroner, PLC 418 East Water Street Charlottesville, VA 22902 Fax (434) 972-4126 RE: Tax Map 80, Parcel 48 & Tax Map 94, Parcel 1 (the "Property") Glenmore Phase 2, Section S5 Glenmore Associates Limited Partnership - Owner Dear Mr. Caramanis: At your request we have examined our records with respect to that certain land and proposed improvements thereon located in Albemarle County, Virginia, identified as Tax ID Nos. 08000-00-00-04800 & 09400-00-00-00100 (the "Property"), please be advised of the following: The Property is currently zoned Planned Residential Development (PRD), approved by the Board of Supervisors on October 10, 2007, with proffers (ZMA200600015). According to the County's records, the Property consists of 1.15 acres and 28.13 acres respectively for a total of 29.28 acres. The proffers limit the uses on the Property and limit the number of single-family units to forty-three (43), (see attached ZMA approval letter, Proffers and Application Plan ("Rezoning Plan", dated September 10, 2007). There are no pending applications to amend the zoning of the Property or for any special use permit or variance. ■ A preliminary subdivision, SUB200800093, was approved on May 20, 2008 to allow 43 single-family residential lots and associated improvements on this Property. The final subdivision, SUB20090004 has not been approved. However, the preliminary subdivision, SUB200800093, was valid on January 1, 2009. Therefore, under the State Code provision (15.2-2209.1) the Piedmont Realty Holdings II, LLC 2 December 29, 2011 preliminary subdivision approval is valid through July 1, 2014. (see attached letter from William D. Fritz, dated May 19, 2009). ■ To the best of my knowledge, the proposed use of the Property as described herein complies or will comply with all applicable requirements of the zoning ordinance of the County of Albemarle, Virginia. There are no current or active violations or proceedings to challenge the zoning or approvals of the Property pending. Please contact me if you have questions or require additional information.
