designated on Tax Map 90 as Parcels 5, 6D,1 5A & 17D, Tax Map 90A as
Parcels 1 A, 1 B, 1 C & 3 and Tax Map 90A1 as Parcels 1 & 1 E
CORRECTED LETTER
Dear Ms. Shipman:
This letter replaces the letter to you dated October 14, 2005. This letter
correctly states that T. M. 90 — 6D is zoned Rural Areas- RA and
Residential- R-1. No other changes have been made. Please refer to the
enclosures included in the October 14, 2005 letter.
You have asked for a letter that provides an analysis of the zoning and other
information regarding the referenced property. This letter is based solely on a
review of our zoning records. We have not preformed an on-site inspection of
the property.
Our Computer Assisted Mass Appraisal (CAMA) property records contain the
following information:
T.M. 90-5 contains 193.791 acres and 1 dwelling. This parcel is in the
Residential- R-1 zoning district and in the Airport Protection -AIA overlay
district. The portion of the parcel adjacent to Old Lynchburg Road is in the
Entrance Corridor -EC.
T.M. 90-6D contains 1,029.303 acres and 1 dwelling. This parcel is split
between the Rural Areas- RA and Residential- R-1 zoning districts. The line
between the two zoning districts can be seen on the enclosed Tax Map. The
portion of the parcel adjacent to Route 20 is in the Entrance Corridor -EC
overlay district.

T.M. 90-15A contains 0.229 acres and zero dwellings. This parcel is in the
Rural Areas- RA zoning district. (This parcel is identified as a well lot on a
survey by Thomas Lincoln dated October 9, 2004.)
T.M. 90-17D contains 2.600 acres and zero dwellings. This parcel is in the
Residential- R-1 zoning district. The portion of the parcel adjacent to Route 20
is in the Entrance Corridor -EC overlay district.
T.M. 90A -1A contains an undetermined number of acres and zero dwellings.
This parcel is in the Residential- R-2 zoning district and in the Airport
Protection -AIA overlay district. (This parcel is identified as a well lot
containing 0.710 acres on a survey by Thomas Lincoln dated October 9,
2004.)
T.M. 90A-1 B contains an undetermined number of acres and zero dwellings.
This parcel is in the Residential- R-2 zoning district and in the Airport
Protection -AIA overlay district. (This parcel is identified as a well lot
containing 0.229 acres on a survey by Thomas Lincoln dated October 9,
2004.)
T.M. 90A-1 C contains an undetermined number of acres and zero dwellings.
This parcel is in the Residential- R-2 zoning district and in the Airport
Protection -AIA overlay districts. (This parcel is identified as a well lot
containing 0.459 acres on a survey by Thomas Lincoln dated October 9,
2004.)
T.M. 90A-3 contains 130.962 acres and zero dwellings. This parcel is in the
Residential- R-2 zoning district and in the Airport Protection -AIA overlay
district.
T.M. 90A1-1 contains 8.900 acres and zero dwellings. This parcel is in the
Residential- R-2 zoning district and in the Airport Protection -AIA overlay
district.
T.M. 90A1-1 E contains 1.500 acres and zero dwellings. This parcel is in the
Residential- R-2 zoning district and in the Airport Protection -AIA overlay
district.
T.M. 90-5, T.M. 90-6D, T.M. 90A-1 C, T.M. 90A-3, T.M. 90A1-1 and T.M.
90A1-1 E all contain areas of flood plain associated with Biscuit Run and its
tributaries.
2. The uses that are permitted by right and by special permit in the RA district
are set forth in Section 10.2.1 and 10.2.2. The uses that are permitted by right
and by special permit in the R-1 district are set forth in Section 13.2.1 and
13.2.2. The uses that are permitted by right and by special permit in the R-2

district are set forth in Section 14.2.1 and 14.2.2. A copy of these sections is
enclosed.
3. The abutting parcels are zoned Residential- R-2 and R-6, Planned
Residential Development- PRD and Rural Areas -RA.
4. We have no record of unresolved zoning complaints or zoning violations
regarding uses or improvements on the referenced parcels in our records.
5. A special use permit, SP -86-32, was approved on August 6, 1986 for a Class
B Home Occupation for a sculpture studio on tax Map 90, Parcel 5. This use
is accessory to the dwelling located on this parcel. The permit is conditioned
upon the maintenance of sight distance.
Our records also indicate that a special permit for a PUD, SP -80-24, was
approved for Parcel 5. The file documenting this action has been lost. No
PUD was developed on this parcel.
6. We have no record of the granting of variances, rezonings or special permits
apart from SP -86-32 and SP -80-24 for any of the referenced parcels.
7. In the event of casualty, the conforming improvements located on the
property may be reconstructed to their current location and dimensions.
Legally non -conforming improvements, including the facilities on the well lots,
located on the property, if any, may be reconstructed to their current location
and dimensions in accord with the provisions of Section 6.3 of the zoning
ordinance.
8. Each of these parcels is recognized in our records as a separate parcel that
may be conveyed, leased or mortgaged. The parcels are subject to any
restrictions contained in any recorded documents that constitute the chain of
title. No new certificate of occupancy or inspection will be required upon the
sale, lease, transfer or other chance of ownership. T.M. 90-15A and T.M.
90A-1 A, 1 B & 1 C do not meet the requirements for area in the RA and R-2
zoning districts. They may continue to be used as well lots. No other legal
nonconforming issues regarding these parcels are identified in our records.
9. A search of our computerized records back to 1991 revealed no Certificates
of Occupancy. It is the policy of this department to purge building permit files
after three years. Copies of Certificates of Occupancy are maintained on
microfilm. Therefore, we have not retained any copies of Certificates of
Occupancy associated with this project. You may obtain a copy of a certificate
of occupancy for an additional fee. The absence of a Certificate of Occupancy
for the project will not give rise to any enforcement action. A Certificate of
Occupancy will only be required to the extent of any construction activity in
the future.
