Dear Ms. Boyd: You have asked for a letter that provides an analysis of the zoning and other information regarding the referenced property. This letter is based on a review of our zoning records and an inspection of the site conducted on January 13, 2005. Our property data base records indicate that this parcel contains 22.753 acres and is in the Rural Areas Zoning District. The property is improved by the Albemarle Farm Store. This use is designated as farm sales and is permitted by special permit in the RA district. The Board of Supervisors approved SP -2001- 055 on February 20, 2002 with conditions. This use is also subject to the supplemental regulations contained in Section 5.1.35. The site is developed in accord with the site development plan approved on January 31, 2002. The permitted activities on the site are further clarified in two letters from me to William Moses, dated July 17, 2003 and August 5, 2003. Copies of the Special Permit approval letter, supplemental regulations, the site plan, and the two letters are enclosed. 2. We have no record of unresolved complaints or violations regarding uses or improvements on the referenced parcels in our zoning data base. 3. The parcel is recognized in our records as a separate parcel that may be conveyed, leased or mortgaged. Tara Rowan Boyd February 8, 2005 Page 2 4. In the event of casualty to the project, in whole or in part, the project will be permitted to rebuild in accord with the approved site plan. If the ordinance is changed in the future, the site could be rebuilt as provided in Section 6, Nonconformities. 5. When inspected on January 13, 2005, The site was found to be in compliance with zoning regulations with two exceptions. The painted pedestrian cross walk is partially obscured by an asphalt repair job. The crosswalk must be restriped. The site development plan shows an undisturbed runoff buffer. Some clearing has occurred in this area and a lawn has been established. The site plan must be amended to either demonstrate that water quality standards are met, in which case the notes regarding the buffer can be removed, or to show alternative water quality measures. I am assured by the County Natural Resources Manager that there is ample room on this. parcel to adequately address this issue. Please contact me if you have questions.
