Proposed lawn care and golf course products supply dealer
Dear Mr. Sweet:
You have asked if a lawn care and golf course products supply business is permitted on Tax
Map 76M1, Parcel 23. The business you describe provides lawn care products that include
grass seed, herbicides, pesticides and fertilizers. It also provides products for the maintenance
of and service of golf courses that include parts for mowers, sprayers spreaders, renovators,
hand held equipment, golf accessories and irrigation equipment. The business deals with
professional landscapers and turf care equipment providers.
The parcel is zoned PUD with a Light Industrial designation and is located in the Airport Impact
Area Overlay District.
Section 27.2.1.17 allows wholesale businesses that do not involve the storage of gasoline,
pesticides, poisons and other materials which could be hazardous by right in this district.
The above described use is determined to be a wholesale business that requires a special use
permit as specified in section 27.2.2.6.
Subordinate retail sales that do not exceed 15% of the floor area of the wholesale business are
permitted by right, subject to the supplemental regulations in section 5.1.24. Section 27.2.2.13
requires a special use permit for subordinate retail sales that exceed 15% of the floor area.
An engineer's report as specified in section 26.7 will be required.
The zoning ordinance sections are provided here for your reference. Your letter of November
13, 2006 is attached for a more complete description of the business.

27.2.1 BY RIGHT
17. Warehouse facilities and wholesale businesses not involving storage of gasoline, kerosene or
other volatile materials; dynamite blasting caps and other explosives; pesticides and poisons;
and other such materials which could be hazardous to life in the event of accident. (Added
12-2-87)
27.2.2 BY SPECIAL USE PERMIT
6. Wholesale business not permitted under section 27.2.1.17. (Amended 12-2-87)
13. Uses listed under section 27.2.1 with subordinate retail sales exceeding fifteen (15) percent of
the floor area of the main use. (Added 2-20-91)
5.1 SUPPLEMENTARY REGULATIONS
5.1.24 SUBORDINATE RETAIL SALES
This provision is intended to permit retail sales as subordinate to the main use. To this end, the
following regulations shall apply:
a. Retail sales area, including but not limited to showroom and outdoor display area, shall not
exceed fifteen (15) percent of the floor area of the main use except as provided for in section
27.2.2.13; (Amended 2-20-91)
b. Retail sales shall not precede establishment of the main use. Retail sales shall be permitted
only after or simultaneously with the establishment of the main use and shall not continue
after discontinuance of the main use; (Adopted 12-2-81)
c. In approval of any retail sales area the board and/or the commission may limit the areas for
retail sales in both size and location; (Added 2-20-91)
d. Retail sales area exceeding fifteen (15) percent of the floor area of the main use pursuant to
section 27.2.2.13 is intended to allow for uses which by their nature are bulky and require
nonintensive use of the land. The board and/or the commission in approval of such increased
sales area shall be mindful of the intent of this section to provide for only subordinate retail
sales and avoid incompatible land uses. (Added 2-20-91)
26.7 PERFORMANCE STANDARDS
Each future occupant of an industrial character shall comply with standards set forth in section
4.14 and submit to the county engineer as a part of final site development plan approval, a
certified engineer's report describing the proposed operation, all machines, processes, products and
by-products, stating the nature and expected levels or emission or discharge to land, air and/or
water or liquid, solid or gaseous effluent and electrical impulses and noise under normal
operations, and the specifications of treatment methods and mechanisms to be used to control such
emission or discharge. The county engineer shall review the applicant's submittal and make
comment and recommendation prior to final commission action on the site development plan.
Subsequent occupants shall comply with the standards of section 4.14 whether or not additional
site development plan review is required.
