College 16th Floor Charlottes, NC 28202 RE: Holiday Inn at 1-64 & 1200 5th St. Tax Map 76, Parcel 55C Dear Wachovia Representative: Fax (434) 972-4126 You have asked for a letter that provides an analysis of the zoning and other information regarding the referenced property, located at the corner of Interstate 64 and 5th Street in Charlottesville, VA. This letter is based on a review of our records and an inspection of the site. 1. The property is zoned HC, Highway Commercial. 2. This property is located in The EC, Entrance Corridor Overlay District and the AIA, Airport Impact Area Overlay District. 3. The property is developed as a hotel which is a by -right use in the HC district. 4. The property is developed in accord with SDP- 173 that was approved by the planning commission with conditions on August 7, 1972. The plan shows 134 units and 168 parking spaces. The plan includes a 102'— 8" x 33'— 4" commercial area. Separate areas used for meeting rooms and the restaurant are not delineated and parking for those separate uses is not specified on the plan. Therefore, I can not determine if the parking conforms to our current ordinance. I - the parking does not meet current standards it is considered to be legally nonconforming. A copy of the approval letter is enclosed. 5. The parcels abutting the property are zoned Highway Commercial- HC. The right of way for Interstate 64 is not zoned. 6. Two variances have been approved for this property. Two variances have been denied for this property. These are described as follows: VA -1972-21, approved on January 30, 1973 by the BZA, allowed a sign 43'— 11" tall and 10 feet wide at a height of 48 feet with flashing lights. The Board of Supervisors appealed the provision of flashing lights to the Circuit Court. I am not aware of the outcome of the appeal. Minutes of this proceeding are enclosed. VA -1974-18 was denied. It would have allowed a reduction of the 30 foot set back for a sign. VA -1979-62, approved on November 13, 1979, allowed a wall sign of 219 square feet. The action letter is enclosed. VA -1983-81 was denied. It would have allowed an increase in the height of a free standing sign and the area of a free standing sign and of a wall sign. 8. Our records show all required Certificates of Occupancy for the parcel have been issued. It is the policy of this department to purge building permit files after three years. Copies of Certificates of Occupancy are maintained on microfilm. Therefore, we have not retained any copies of Certificates of Occupancy associated with this project. Furthermore, the absence of a Certificate of Occupancy for the project will not give rise to any enforcement action. Please be aware that interior renovation that does not involve a change of use does not require a Certificate of Occupancy. You may obtain a copy of a Certificate of Occupancy by contacting Kathy Martin @ 434-296-5832 ext. 3550. 9. The proffers for ZMA-1990-13- Young America require a joint entrance for Tax Map Parcels 76M(1)-1 and 76-55A and the Holiday Inn property. A copy of the proffers is enclosed. 10. The property was inspected on January 4, 2007. No site violations were identified. Please contact me if you have any questions or need further assistance.
