Dear Sir or Madam:
In response to your request concerning the above referenced Property's compliance
with applicable codes, regulations and ordinances, please be advised as follows:
The Property is currently zoned R -6, Residential and is located in the
Entrance Corridor Overlay District (EC) and Airport Impact Area (AIA).
Nursing Homes are allowed in R -6 by Special Use Permit. SP1985 -004 was
approved with conditions on March 20, 1985 to allow a 120 bed nursing home
facility. A copy of the approval letter with conditions is attached, along with
the Virginia Department of Highways letter approving the entrance. The
Property is in compliance with zoning district regulations.
According to the County's property records, the building was constructed in
1987. The site was developed under SDP1986 -28 which was approved for
120 beds served by 116 spaces. A minor amendment, SDP1995 -56, was
approved for a dining hall addition. The Property was built in accordance
with the approved site plans.
The off -site sign is subject to a Special Use Permit, SP2009 -005, which was
heard and granted by the Board of Zoning Appeals on April 7, 2009. The
Property is in compliance with the sign ordinance.

The Property was inspected on April 2, 2014 and there appear to have been
several dumpsters added in the rear parking lot, which have not been
approved with a site plan amendment and do not meet standards for
dumpster pads and screening. Please see the excerpt from the Albemarle
County zoning ordinance (Section 4.12.19) regarding dumpster design
requirements.
■ In the event of damage or destruction, the facility can be rebuilt on the
Property as it currently exists, subject to dumpster approval.

Dear Sir:
The Albemarle County Board o� Supervisors, at their.meeting on March 20, 1985, unanimously
approved the above -noted request to locate a 120 bed nursing home on a vacant 9+ acre
parcel. Zoned R -6, Residential,, the' property described as Tax Map 45, Parcel 26 is
located on Rio Road West, approximately 1/10 mile west of Route 659 (S.P.C.A. Road).
Charlottesville Magisterial District. This request was approved subject to the following
conditions:
1. Nursing home facility limited to 120 beds. Future expansion shall require
amendment of this special use permit..
2. Approvals of appropriate state and local agencies.
3. Maintenance of an undisturbed buffer area at least 50 feet in depth along all
common boundaries of Four Seasons PUD and Berkeley Subdivision.
4. Additional buffering/ screening may be required by the Planning Commission, at time
of site plan review, as well as measures for maintenance of existing cemetery.
5. Fire Official approval of method of fire protection prior. to site plan review by
Planning Commission.
6. Virginia Department of Highways and Transportation approval of commercial entrance
location prior to Planning Commission review of site plan.

7. No access to be allowed through'Berkeley or Four Seasons subdivision.

Dear Mr. McKee:
This is in reference to your proposed entrance on Route 631 for the above
development. If this entrance has to be approved by Albemarle County then the
Department comments are as follows.
The plan dated October 7, 1985, that shows a connection with Route 631 for
the proposed Heritage Hall Nursing Home is at the location where the Department
has already reviewed. There is a painted yellow arrow on the edge of the pave-
ment marking this location. This is approximately 50' to the west of a utility
pole. To obtain adequate sight distance to tht east, a.sight easement will' be
required on the property of the Gardem:5pot. Also right of way dedication will
be necessary across the frontage of the nursing home property so that adequate
sight distance can be maintained as well as allow for the construction for turn
lanes.
These comments are for the preliminary plan submitted previously and the
Department will address more specific comments at the time a sight plan is
filed with the County.

blocks or posts be used to delineate loading spaces on surfaces that are not conducive to paint
striping.

4.12.19 MINIMUM DESIGN REQUIREMENTS AND IMPROVEMENTS FOR DUMPSTER PADS
The following design requirements and minimum improvements shall be satisfied for all vehicle
access aisles:
a. Materials. Dumpster pads shall be concrete.
b. Design. The pad shall extend beyond the front of each dumpster so that the front wheels of a
truck servicing the dumpster will rest on the concrete, but in no case shall the length of a
concrete pad be less than eight (8) feet beyond the front of the dumpster. The site shall be
designed so that stormwater does not ran through, and drains away from, areas where
dumpsters are located in order to minimize the potential for contaminating stormwater runoff
due to contact with solid waste.
c. Screening. Dumpsters shall be screened as required by section 32.7.9 and, where applicable,
section 30.6.

4.14 PERFORMANCE STANDARDS''
Each use of an industrial character as determined by the zoning administrator and each use to
which section 4.14 is expressly applicable to that use (referred to collectively in sections 4.14.1
through 4.14.5 as a "use of an industrial character ") shall be subject to the performance standards
in this section through section 4.14.5.

Measurements shall be made at or beyond the closest boundary line of an abutting lot and
the zoning district boundary line closest to the source as provided below in a manner I
accepted by the county engineer.
