Box 189 Free Union, VA 22940 RE: LOD201400005 Tax Map 56A1-01-00-11800, 1278 Crozet Avenue Dear Mr. Lucas: You have asked for an official determination of the nonconforming status of the dwelling located on this parcel. It is my official determination that the original constructed dwelling on this parcel is a legal, nonconforming dwelling. This is based on the following information. Our records indicate this parcel is zoned R2, Residential -2. The R2 zoning district yard requirements setbacks are 25' for the front, 10' for the sides and 20' for the rear. The parcel contains .90 acres and one dwelling unit. Our records indicate that the original structure was built in 1870. At a later time, an addition was built onto the rear of the original structure. A survey of this property shows the original structure 8.3' away from the side property line, which renders it nonconforming as to setbacks. However, the original structure was constructed and a use commenced prior to the establishment of zoning ordinance in 1969, which makes the original structure legally nonconforming. The addition does not run the full width of the original structure, is in conformance with the zoning ordinance and can be demoed and rebuilt or enlarged provided it meets all other ordinance requirements and is no closer than 8.3' from the side property line which is legally nonconforming. A copy of that section is enclosed. If you are aggrieved by this determination, you have a right to appeal it within thirty days of the date notice of this determination is given, in accordance with Section 15.2-2311 of the Code of Virginia. If you do not file a timely appeal, this determination shall be final and unappealable. An appeal shall be taken only by filing with the Zoning Administrator and the Board of Zoning Appeals a notice of appeal which specifies the grounds for the appeal. An appeal application must be completed and filed along with the fee of $120. The date notice of this determination was given is the same as the date of this letter.
