STOP WORK ORDER
Dear Mr. Swartout:

Under §17 -214 of the Albemarle County Code, you are hereby notified to immediately cease all land
disturbing activities on the above referenced property (STOP WORK) with the exception of work to
address the installation of erosion control measures, soil stabilization, and any necessary drainage
corrections as approved by the County. This STOP WORK ORDER shall remain in place for seven (7)
days from the date of receipt, Article II, section 17 -207 requires permanent vegetation to be installed on
all denuded areas within (9) months after the date the land disturbing activity commenced. (January 11,
2011). If satisfactory repairs have not been made within seven (7) days, the County may elect to issue
another Stop Work Order, and /or petition the Circuit Court for penalties and relief with regard to this
violation.
Required Correction(s):
1. Apply permanent vegetation to all denuded areas on site in accordance with 3.32 of the VESCH,
Third edition dated 1992 and the approved erosion and sediment control plan. Have an engineer
contact the Community Development Department to submit an Erosion and Sediment control plan.

NOTICE TO COMPLY
Dear Mr. Swartout:
Under Section 17 -213, of the Albemarle County Code, this is your NOTICE TO COMPLY with the requirements of
the Erosion Control Permit for the referenced property and to immediately take corrective measures that address the
erosion and sediment control deficiencies on this property. The specific deficiencies and measures required to
correct those deficiencies are as follows:
1. Deficiency: E &S control plan dated 11-1-11 has failed to protect the site; controls have been removed and
specifics can be discussed on site.
Required Corrections: Submit an amendment to E &S control plan dated 11 -1 -11 to the Community
Development Department of Albemarle County. Seed and straw mulch site and repair any existing controls
on site not meeting the VESCH Third edition, dated 1992.
Unless subsequently amended in writing by this office, it is expected all of these corrective measures will be
completed by no later than November 21, 2012.
Under Sections 17 -213, 214 and 215 of the Albemarle County Code, failure to make these corrections by the
required date can have the following results:
Your permit may be revoked.
You may be required to submit a new Erosion and Sediment Control Plan and have it approved before
additional land disturbance will be allowed. Review of a new plan can take up to 45 days for each submission
and it is not unusual for several submissions before the plan can be approved. This requirement would include
a new application, fee and bond for the work proposed under the plan.
The County may issue a STOP WORK ORDER and seek relief in the Circuit Court. The Circuit Court can fine
the property owner up to $2,000 per violation, convict the property owner of a Class 1 misdemeanor and require
the property owner to pay any damages resulting from a failure to comply with this notice. Should you have a
legitimate reason you cannot complete the corrective measures by the above given date, you must immediately
contact me at (434) 296 -5832. Unless you have contacted us and alternative arrangements have been agreed to
in writing, we will expect the corrections to be completed by the above date.
