Charlottesville, VA 22902 Re: ZMA 1990 -019: Manor House lot at Glenmore Dear Bill: At a pre - application meeting on February 2, you asked Planning staff whether the boundaries for Tract 1 at Glenmore could be modified and if an additional house could be built in Tract 1. The portion of land you wish to add to Tract 1 currently is in open space. Tract 1 is Tax Map 93A1 -1A and is owned by Peggy Kessler. You indicated that a boundary line adjustment is expected to modify the tract so that it contains the same acreage it currently has. According to the Zoning division, the application plan for ZMA 1990 -019 Glenmore PRD applies to this rezoning as do the General Conditions in the "Textual Statement" from the 1990 rezoning. Item 8 of the General Conditions says that interpretations and clarifications of the application may be made by the Planning Director. This letter has been written in conjunction with the Zoning division and confirms that your request is allowed within the confines of the General Conditions which state that the acreage within each tract may be adjusted provided that no increase in area may exceed 15% for the tract. The General Conditions also state that common open space may be altered by 15% provided that Zoning Ordinance sections 4.7 (open space) and 19.6.1 (open space in PRD) requirements are met. The reviewing Planner for the boundary line adjustment will need to verify that the General Conditions are met prior to approving the boundary line adjustment. No variation is necessary. The Kessler Group (Attn: Frank Kessler) FROM: Amelia'M. Patterson,,r�, Zoning Administrator DATE: May 29, 1991 RE: Zoning Approval for Work in Floodplain - Compliance with Section 30.3 It is my opinion, after researching relevant files and consulting several staff members, that a new and separate special permit for work currently proposed in the floodplain is not necessary. Therefore, the application for SP -91 -27 the Kessler Group is hereby void, and the fee will be refunded. This memo refers to work shown on the Glenmore Master Plan by Clower Associates, dated September 24, 1990 with last revision on November 2, 1990. This work is also shown on the current erosion control plan. It includes ponds, fill, culverts, grading, utilities and the like, for the golf course, trails and associated elements in the floodplain. Further special permit review under the flood overlay by the Board of Supervisors is not necessary. The floodplain work was adequately addressed with the review of the rezoning so as to sufficiently comply with the intent and procedural requirements of the Zoning Ordinance. This is based on the following: 1. This work was shown on the master plan approved by the Board of Supervisors as the rezoning application plan; Memo on Glenmore - Work in Floodplain May 29, 1991 Page 2 2. A separate application form for special permit submitted with the rezoning (attached) outlines this work in the floodplain. Section 19.3.2 P.R.D. states, ". . . no separate.application shall be required for any such use as shall be included in the original P.R.D. rezoning petition." 3. The work proposed in the flood plain and its impact was discussed in the ZMA and CPA staff reports for the Planning Commission and Board of Supervisors. 4. Mr. Tom Gale has confirmed compliance with Section 30.3 as to the technical components. He has stated that there is no excess filling; that the flood level will not be elevated; and that there will be no negative impact on downstream properties.
