To Whom It May Concern:
In response to your request for a Letter of Zoning Compliance for the above referenced
Property, please be advised of the following:
• The Property is zoned R -15, Residential. Rest home, nursing home, convalescent home,
orphanage or similar institution is a use permitted by special permit in this district. These
institutions are subject to the supplemental regulations found in Section 5.1.13 of the Zoning
Ordinance.
• This Property is subject to the following Special Use Permit, SP- 1992 -00025 approved on
June 17, 1992 to allow an assisted living facility with a condition that limited the facility to 80
beds. This permit is not subject to expiration. Copies of approvals may be obtained as
noted below.
This Property is subject to the following Site Development Plans, SDP - 1992 - 00065 -Final &
SDP - 1994 - 00018 - Minor. The Property appears to have been developed per the approved
plans. A site inspection was completed and revealed some inconsistencies with the
approved site plan. These inconsistencies relate to the landscaping approved with the 1992
site plan. Some of this landscaping no longer exists in multiple locations throughout the site.
It is the responsibility of the property owner(s) to maintain the site as approved on the noted
site plan. Changes to the site must be approved though the site plan amendment process.
County staff understands that landscaping dies and is sometimes not replaced. At this time
no complaint regarding the missing landscaping has been received by this office. Thus, the
County will not be pursuing a violation of the site plan at this time. Copies of plans may be
obtained as noted below.
• This office has no record of any open violations for this parcel.
• A survey of the Property revealed building corners that are 14.90 feet and 14.86 feet from
the side property line. While the minimum setback for side yards in R -15 zoning is 15 feet,
these are off by less than 1 foot and considered to be De minimis. The county does not
pursue such minor discrepancies.
• Copies of special use permits, site plans, erosion & sediment control plans and certificates
of occupancy may be obtained from this office with a request through the department's
Records Manager, Esther Grace, at 434 - 296 -5832 ext. 3823.
