RE: Major Site Plan Amendment Tip Top Restaurant Parking Expansion -
Parking Determination
Dear Mr. Myers:
You submitted a request to exceed the maximum number of parking spaces for Tip Top
restaurant for a total of 102 proposed spaces. You calculated the total restaurant area
to be 5,247 square feet (including 230 square feet of outdoor patio space). Based upon
the 13 spaces/ 1,000 square foot of gross floor area requirement for a restaurant use, a
minimum of 68 parking spaces are required. Under Section 4.12.a of the zoning
ordinance, a maximum of 20% additional or 14 spaces may be provided, for a total of 82
spaces, the current number of parking spaces provided onsite.
On July 21, a parking study was submitted indicating that the current parking area
regularly exceeds its parking capacity during weekday lunches and on weekends
causing customers to leave or wait for a parking space to become available. Your
request to exceed the 82 space maximum is based upon ITE trip generation data for a
high turnover restaurant generating peak traffic activity at 20 trips/ hour per 1,000
square foot or 105 vehicles/ hour. You have also provided parking information for a
similar site with a parking to square footage ratio of approximately 23 spaces per 1,000
square foot.
I concur with your conclusion that the proposed alternate solutions to off - street parking
are impractical given the location of the site on a corridor with limited pedestrian and
transit facilities. In addition, it is my opinion that the location of the property adjacent to
two car dealerships is such that an increase in the number of parking spaces on this
parcel would not likely adversely impact the character of adjoining properties.
Please be aware that any modification of the uses on the site or change of ownership,
prompting the requirement for a new zoning clearance, may necessitate a modification
of the parking requirements.

Because this is a determination, I am including the appeal language as is standard
practice. Feel free to contact me if you have questions.
If you are aggrieved by this determination, you have a right to appeal it within ten (30)
days of this notice, in accordance with Virginia Code § 15.2 -2311; provided, however,
that a ten (10) day appeal period applies to appeals of decisions pertaining to
temporary or seasonal commercial uses, and such appeals shall be filed within ten
(10) days after this decision. If you do not file a timely appeal, this determination shall
be final and unappealable.
An appeal may be taken only by filing an appeal application with the Zoning
Administrator and the Board of Zoning Appeals, in accordance with Albemarle County
Code § 18 -34.3, along with a fee of $240 plus the actual cost of advertising the appeal
for public hearing.
Applications for Appeal of the Zoning Administrator's Determination are available at
the Department of Community Development located at 401 McIntire Road,
Charlottesville, Virginia 22902 or online at www.albemarle.org /cdapps. This form
applies to appeals of decisions of the zoning administrator or any other administrative
officer pertaining to the Zoning Ordinance.
