This parcel is 0.0540 acres in area and is not contiguous to any other open space in Briarwood. The County has received a subdivision application and road plan to construct a private road, Elm Tree Court, through the open space mentioned above in order to access the commercial property along Route 29, Tax Map Parcel 032GO- 00- 00- 00OA0. To facilitate the proposal as currently designed a Variation to the Briarwood PRD application plan (ZMA2005- 09) is required. The approved application plan does not depict a road in this location. Attached is the applicants Variation request. This item is required to go to the County Board of Supervisors for consideration and approval. Attached to this letter is a scanned copy of the applicable section of the final subdivision plat and landscaping plan which depicts the proposed road location and proposed tree plantings to act as a buffer between your property and the road. Describe the variation being sought (may attach separate sheets): A variation is being sought to install a private road across a small portion of the open space (0.05 acres) of the Briarwood Development PRD to access the by -right C -1 commercial property along Route 29. Because this small pertien ef the epen spaee is part of the approved Briarweed PRD, it is subjeet to proffers and an application plan, and minor changes to the street design and street location must be approved with a variation. Therefore, we are hereby requesting a variation to add a private street across 0.05 acres of open space to access the by-right commercial property along Route 29 This added street is a varia-tion to the proposed streets as shown in the approved rezoning. What is the reason for each of the requested variations ?: During the design of the access roads for the commercial properties along Route 29 located within the Briarwood development, it was determined by both VDOT and the County Engineer that the access road proposed ivate street accessing the commercial lots to the south of Briarwood Drive. This modification would allow more room for access and stacking of cars along Briarwood Drive and help eliminate the concern of any stacking bark onto Route 99 in addition, thp proposed private street on tbe south -,RrJe of Rriarwood Drove was hifted west to provide the required minimum setback from Route 29. Both of these changes caused the private streets accessing the by-right commercial property to have a slight impact on the open space area Shown in the approved PRD for Briarwood. The reduction of this 0.05 acres of open space will have minimal affect on the current provided open space for Briarwood, which is currently at approximately 27% open space. Yes. It provides a parallel road to access the commercial lots along Route 29. 1, 2. Does the variation increase the approved development density or intensity of development? No. It has no effect on the density of the development. 3. Does the variation adversely affect the timing and phasing of development of any other development in the zoning district? No. This does not affect any of the proposed development within Briarwood. 4. Does the variation require a special use permit? No. 5. Is it in general accord with the purpose and intent of the approved rezoning application? Yes. The proposed roadway affects only 0.05acres of the approved PRD property. § 8.5.5.3 VARIATIONS FROM APPROVED PLANS, CODES, AND STANDARDS OF DEVELOPMENT The director of planning and community development may allow a site plan or subdivision plat for a planned development to vary from an approved application plan, standard of development and, also, in the case of a neighborhood model district, a general development plan or code of development, as provided herein: a. The director is authorized to grant a variation from the following provisions of an approved plan, code or standard: 1. Minor variations to yard requirements, maximum structure heights and minimum lot sizes; 2. Changes to the arrangement of buildings and uses shown on the plan, provided that the major elements shown on the plan and their relationships remain the same; 3. Changes to phasing plans; 4.
