Please consider the following application for waiver of the street standards and inclusion of private streets
at the Avinity H project ZNM201300016:
In accordance with Sec. 14 -233, the applicant requests authorization to develop Roads A, B, C, D and the
continuation of Avinity Loop (as delineated on the Avinity II PRD Application) as private streets. The
applicant also requests a waiver of street standards to allow a street section with sidewalk adjacent to the
back of curbing, and street trees within a landscaping maintenance and access easement. These street
standards will serve to create a consistent streetscape and provide,a design more suited to the general
welfare of the Avinity existing residents.
The proposed Avinity II streets are continuations of the existing private Avinity I streets. The proposed
Avinity II streets will be built to state standards and will be adequate to carry the anticipated subdivision
traffic volumes. Due to design restrictions, the Avinity H roadways propose sidewalk adjacent to the back
of curbing. This is concurrent with the design of Avinity I and will provide continuity between the
Avinity I and II designs. All utilities will be provided in the street to allow for landscaping as shown in
the application plan.

RE: Estes Park — Request for Modification for the building separation requirement
Dear Megan Yaniglos;
Please allow this letter to serve as our formal request for a modification to the PRD building separation
requirements under 19.8 of the ordinance. The current PRD under review for approval through the rezoning
process proposes the establishment of 5' side yard setbacks with a 10' minimum building separation in lieu of
the current 30' building separation requirement. The proposed side yard setbacks will also allow a 1'
encroachment into the side yards for overhangs and other architectural elements of the house, provided that
they meet the one hour fire rated requirements.
The project meets the guidelines for this reduced building setback as outlined in the zoning ordinance. The
fire flow for the development and the building separation of 10' is acceptable to the Fire and Rescue
department, allowing the approval of this modification.
