Variation approved with this project at the July 29, 2014 Planning Commission meeting
under SUB2014 -120
1) Variation to the planting strip requirements, from six (6) feet to three (3) feet width and allow
the planting strip to be located on the back side of the sidewalk, in accordance with 14- 422(F) of
the Subdivision Ordinance.
Approved with a condition "The required street trees will be provided behind the sidewalks in
landscaping easements to be recorded on a plat and depicted on the final site plan. "
Special Exceptions and Variation approved with this project at the September 3, 2014 BOS
meeting under SUB2014 -120 and SDP2014 -47
1) Buffer Zone Disturbance Waiver Section 21.7(c) — to disturb the 20 foot buffer zone
adjacent to residential districts to facilitate construction of Boulderview Road and Elm Tree
Court. Portions of each street are to be located within the 20 foot buffer, as well as grading and
landscaping associated with a landscape mitigation plan to remedy a site plan violation on the
property. With a condition of approval that: "Landscaping shall be installed as depicted on
SDP2013 -35 Landscape Mitigation Plan which provides plantings between the proposed road
and Briarwood property line. "
2) Variation to Briarwood PRD application plan (ZMA2005 -09) — A variation to Briarwood's
application plan was approved to construct Elm Tree Court on a portion of open space associated
with the Briarwood PRD. With a condition of approval that: "Landscaping shall be installed as
depicted on SDP2013 -35 Landscape Mitigation Plan which provides plantings between the
proposed road and Briarwood property line. "
3) Setbacks for Fuel Storage Tank Waiver Section 5.1.20(b) — to locate the gas station's
underground storage tanks and loading facilities closer than the required 100' from any property
line provided they meet the requirements of Section 5.1.20(a), which is a 3 foot setback."
