RECORD AND DEVELOPMENT RIGHTS - Blandemar
Farm, Tax Map 88, Parcel 1
Dear Mr. Hughes,
This is in response to your July 10th transmittal to me requesting
a determination. I have already verbally confirmed my response.
You will note that I have chosen to carbon copy interested parties
who are entitled to appeal this determination. It is my
determination that on the date of adoption of the Zoning
Ordinance, December 10, 1980, the above-noted property consisted
of nine (9) separate parcels of record. Each parcel has
theoretical development rights.
This finding has been confirmed by the County Real Estate records,
deeds and plats, and by reviewing all files within the Planning
and Zoning Departments. Plats recorded after the ordinance
adoption include reference to the residue consisting of several
parcels. Your recent survey of April 6, 1990 shows the location
of the internal property lines delineating the parcels. The
County records were revised to combine these into one parcel
listing, based on a May/June 1961 plat by 0. R. Randolph. This
plat was a composite plat for the land purchase, and not one to
combine parcels.

*As a result of subdivision after December 10, 1980, some of these
development rights have diminished. These are theoretical
development rights. Actual development shall comply with the
Subdivision and Zoning Ordinance.

It is unfortunate that this discovery of additional development
.rights is made after significant public interest and concern and
much County review for several proposed subdivisions and special
permits. I urge you to contact Planning staff to discuss an
orderly and logical development of this property.

Anyone aggrieved by this decision may submit a written appeal with
justification thereof, within 30 days of the date of this letter.
An appeal is heard by the Board of Zoning Appeals pursuant to
Section 34.3.

Please be advised that an appeal has been filed by Richard E.
Carter for David Bass, in regard to the "Official Determination of
Parcels of Record and Development Rights - Blandemar Farm, Tax Map
88, Parcel 1" by Amelia M. Patterson in her letter dated August
20, 1990. The Board of Zoning Appeals will hold a public hearing
on this issue in November. You will be notified once the meeting
date is determined.
