Payne Attorney at Law 412 East Jefferson Street Suite B Charlottesville, VA 22901 RE: OFFICIAL DETERMINATION OF DEVELOPMENT RIGHTS Tax Map 112, Parcel 20 Dear Mr. Payne: This acknowledges 'receipt of yours of August 9th. I concur with your analysis. It is my opinion that the approximate 31 acre portion of parcel 20 which lies on the west side of Route 20 is separate from the major portion of parcel 20 which lies on the east side of Route 20, part of property known as Viewmont Farm. Each portion is therefore entitled to separate sets of development rights. This determination is consistent with the findings of Judge Pickford in the case of Ann H. Sanford vs Board of Zoning Appeals of Albemarle County, Virginia (case No 3984 -L) . -In this case, we also found the source deed (DB 301,/243), to clearly show the approximate 31 acre parcel as separate. You will note that by carbon copy, the County Planning and Real Estate Departments are notified of this determination. If you have any questions, please contact our office. Sincerely, Amelia M.
