Associates, Inc. 1717 Allied Street Charlottesville, VA 22901 RE: •,OFFICIAL DETERMINATION OF NUMBER OF PARCEL(S) - Section 10.3.1, Tax Map 121, Parcel 46 Dear Mr. Ray: The County Attorney and I have reviewed the chain of title you have submitted for the above -noted property. It is the County Attorney's advisory opinion and my official determination, that this property consists of three (3) separate parcels. Each of these lawfully separate parcels is entitled to associated development rights. This determination considered the descriptive clauses of the deeds, which delineate and enumerate the property as consisting of three (3) parcels. This consideration is based on the findings of the Virginia Supreme Court in the case, Faison v. Union Camp 224 VA 54. The property was acquired by two separate deeds. One of the most current deeds of record is found in DB 231 page 107, dated April 8, 1936 from Johns to Joe Agee. This deed describes the following parcels: 1. Tract containing 11 acres, more or less (5 development rights.); 2. Tract containing 4 45/100 acres, more or less (2 development rights) ; - - -- -The otherdeed —is - found - in- DB 1G3 ; —Page 205— dated January- -21 -i- 19 from Gemminger to James Agree. This deed describes the following parcel: 3. Tract containing 19 1 /10-acres, more or less (5 development rights).
