Ray, C.L.S. 1717 Allied Street Charlottesville, VA 22901 RE: OFFICIAL DETERMINATION OF NUMBER OF PARCELS — Section 10.3.1 Tax Map 100, Parcel 17 Dear Mr. Ray: I have reviewed the chain of title you have submitted for the above -noted property. It is my official determination, that this property consists of two (2) separate parcels] which total approximately 240 acres lying on the west and east sides of Route 631. Each of these lawfully separate parcels is entitled to associated development rights. This determination considered the descriptive clauses of the deed, which delineate and enumerate the property as consisting of tract #1 and tract #2• This consideration is based on the findings of the Virginia Supreme Court in the case, Faison v. Union Camp 224 VA 54. It is further based on the Inglecress /Sanford case. That case also involved dedication of fee simple right -of -way for a public road. The most recent deed of record as of the date of adoption of the Zoning Ordinance is found in Deed Book 390, Page 400. It is dated May 5, 1963 from Ruby Smith and others to the Commonwealth of Virginia. This deed describes the following: Conveyance of a 50 foot strip or parcel of land over the lands of the grantors along Route 631 between Route 712 and Route 708. A Roger W. Ray August 23, 1991 Page 2 The prior deed of conveyance to Willie and Ruby Smith from Elizabeth Hale is dated February 13, 1948 and recorded in Deed Book 278, Page 74. This deed describes and shows Tract #2 of 168 acres, and Tract #1 of 72 acres. Anyone aggrieved by this decision may file a written appeal within thirty (30) days of the date of this letter.
