Compton Principal Broker /Owner House of "Hallmarke Realtors Charlottesville, VA 22901 RE: OFFICIAL DETERMINATION OF NUMBER OF PARCELS - Section 10.3.1 Tax Map 33, Parcel 51 (Westvaco Corporation) Dear Mr. Compton: The County Attorney and I have reviewed the chain of title you have submitted for the above -noted property. It is the County Attorney's advisory opinion and my official determination, that this property consists of two (2) separate parcels: 1) one parcel of 272.43 acres located on the east side of Route 600 and 2) the other physically separate parcel of 138.25 acres located mostly on the east side of Route 640. Each of these lawfully separate parcels is entitled to associated development rights. This determination results in one additional parcel than is shown with a parcel number on the County tax maps. This determination considered the descriptive clauses of the deed, which delineate and enumerate the property as consisting of two (2) parcels. This consideration is based on the findings of the Va. Supreme Court in the case, Faison v. Union Camp 224 VA 54. The most recent deed of record as of the date of adoption of the Zoning Ordinance is-found in Deed Book 381, Page 245. It is dated August 27, 1962 from J. S. Purcell Lumber Corporation to West Virginia Pulp and Paper Company. This deed describes the following parcels: 1. Tract #3 containing 272.43 acres, as..described under #1 above. December 11, 1991 jI Official Determination of Parcels - Tax Map 33, Parcel 51 Page 2 2. Tract .#2 containing 138.25 acres, as described under #2 above. These two parcels are not physically contiguous at any point. It appears that they were combined by the County Real Estate office by this property conveyance of 1962.
