Higginbotham II Tax Map 110, Parcel 17 Dear Mr. Carter: We have reviewed the composite drawing prepared by Saunders' Surveys, Inc:, .revised April 12, 2000, showing the property of Howard Carr and the property of K. C. Higginbotham and J. H. Higginbotham II. Our findings, including a determination of parcels and the resulting conditions for approval of this plat are set forth in the two attached memoranda. One is from John Shepherd to Yadira Amarante dated September 13, 2000 and the other is from Greg Kamptner to . Amelia McCulley and John Shepherd dated November 6, 2000. Taken together, these memoranda can be relied upon as an official determination. If you are aggrieved by this determination, you have a right to appeal it within thirty days of the date notice of this determination is given, in accordance with Section 15.2-2311 of the Code of Virginia. If you do not file a.timely appeal, this determination shall be final and unappealable. An appeal shall be taken only by filing with the Zoning Administrator and the Board of Zoning Appeals a notice of appeal which specifies the grounds for the appeal. An appeal application must be completed and filed along with the fee of $95. The date notice of this determination was given is the same as the date of this letter. Higginbotham & J.H This plat shows a division line approved by the Circuit Court of Albemarle. The plat is not subject to the subdivision ordinance. The plat is subject to the zoning ordinance. We in this department have reviewed the revised plat and deeds you have submitted, consulted with the Assistant County Attorney, consulted with VDOT and consulted with staff of the County's Real Estate Department. Based on that research, we find that this 308.8 tract is actually comprised of two separate tracts that were combined for tax purposes in 1973 or 1974. One contains 111.9 acres that was divided from the tract in 1924 and described in deed book 186 on page 305. The other consists of the residue containing 196.6 acres. Also, we find that the Sanford rule applies to the portion of Route 633 that is maintained by the State. This results in the division of the 196.6 acre tract into two parcels. However, unless there is evidence that the County owns fee simple title to the non -maintained portion of the road it appears that the Sanford rule does not apply to the purported public road beyond the `End State Maintenance' sign. That said, the Albemarle County Department of Building Code and Zoning Services will approve the above referenced plat for zoning compliance when the following items have been satisfactorily addressed. [4.2.2.1] The area west of the state maintained portion of Route 633 must be shown to contain at least 5 acres. Otherwise, that parcel must be approved by the Department of Health. [10.3.1 & 10.3.2] The three existing parcels each have 5 development rights that must be allocated amongst the three new parcels that are created by this plat. It must be noted on the plat that the aggregate acreage from each original parcel devoted to development lots shall not exceed 31 acres. At least 1 development right must be assigned to the 5 — 6 acre parcel that is located to the west of the state maintained portion of Route 633. Delete the note stating each parcel shall have its full compliment of development rights.
