RE: LOD2014-00013 - OFFICIAL DETERMINATION OF USE - DOMESTIC PET GROOMING
SERVICES (Associated Zoning Clearance CLE201400199)
In accordance with Sections 22.2.1 (C-1, Commercial) and 24.2.1 (HC, Highway Commercial) of
Chapter 18 of the Albemarle County Code which allow for a determination of a use not
specifically permitted, the following use has been determined to be similar to uses permitted by
right in general character and more specifically, similar in terms of locational requirements,
operational characteristics, visual impact and traffic generation:
Domestic pet grooming services. The use has been determined to be similar to the use
identified as "Barber, beauty shop". No overnight boarding of pets is permitted. A
special use permit for a commercial kennel is required to board animals overnight.
This use would also be permitted in the PDSC and PDMC zoning districts as they allow uses
permitted by right in the C-1, and HC districts. Pet grooming in association with a breeding or
boarding operation is permitted within the use category commercial kennel.
If anyone is aggrieved by this determination, they shall have a right to appeal it within thirty (30)
days of this notice, in accordance with Virginia Code § 15.2-2311. If they do not file a timely
appeal, this determination shall be final and unappealable.
An appeal may be taken only by filing an appeal application with the Zoning Administrator and
the Board of Zoning Appeals, in accordance with § 34.3 of the Zoning Ordinance, along with a
fee of $240 plus the actual cost of advertising the appeal for public hearing.
Applications for Appeal of the Zoning Administrator's Determination are available at the
Department of Community Development located at 401 McIntire Road, Charlottesville, Virginia
22902 or online at www.albemarle.orq/cdapps. This form applies to the appeal of a decision of
the zoning administrator or any other administrative officer pertaining to the Zoning Ordinance.
