I have reviewed your request for a zoning determination. I have attached a completed copy of the form you
sent with your application. Please be aware that proffer E of ZMA 2000 — 10 has been deemed complied
with. (This proffer deals with the dedication of right of way.) This right of way was dedicated a number of
years ago. However, due to changes that have occurred in the development it will be necessary for this
right of way to be amended. This issue does not affect your compliance with the zoning on the property
and is provided only for your information. If you need anything else please let me know. .

Name of Proposed Development: Avemore Phase II
Location of Proposed Development: Tax Map 78B, Section 4, Parcel 1 located off of Avemore
Lane on Calvary Circle just east of Stony Point Road (Route 20) in the Rivanna Magisterial
District.
In response to the written request by letter dated March 20, 2007 from the housing
sponsor of the proposed development identified above, the Zoning Administrator of Albemarle
County, Virginia hereby determines. that the proposed development identified above is consistent
with current zoning and other. land use regulation in effect at the time of the written request
referenced above.
The undersigned certifies that he or she is authorized to make this determination on
behalf of the staff identified above.
