SUBJECT/PROPOSAL/REQUEST:
Amendment of the Subdivision Ordinance to allow
submittal of subdivisions involving 50 lots or fewer to
be processed as a final plat without preliminary plat
approval and to make technical changes and correct
omissions made in prior text amendments.

BACKGROUND:
An amendment to the Code of Virginia removes the ability of the County to require the submittal of a preliminary plat prior
to the submittal of a final plat for subdivisions of 50 lots or fewer.
DISCUSSION:
The amendment puts into place a process for the review of final plats submitted prior to preliminary approval. The
process includes notification and reviews that would occur for a preliminary plat.
This amendment also:
- Makes 2 lot subdivisions subject to Section 404 (Single Point of access). The most recent amendments
inadvertently removed the requirement.
- Establishes that plats must be recorded within one year of approval or the approval becomes void.
- Removes the requirement to comply with Section 404 if an SP/ZMA or SDP was previously approved with an
alternate entrance.
- Clarifies powers of the Agent.
- Updates control point definition. (Control points are latitude and longitude coordinates that assist mapping of
the new lot lines in GIS.)
- Updates the subdivision ordinance to reflect provisions in the Water Protection Ordinance.
The impact of this amendment is minimal and does not represent a reduction in the quality of review that will occur.
The amendment retains public notice provisions.
RECOMMENDATIONS:
Staff recommends that the Planning Commission support the proposed amendments and forward them to the Board
of Supervisors with a recommendation of approval.
