The property is subject to the Flood Hazard ( "FHO "), Entrance Corridor ( "EC "), Managed and Preserved Slopes Overlay Districts. • A warehouse is a permitted use in the HC zoning district under the use Light Warehousing. • The abutting zoning districts are HC and do not have any setback regulations. • The property was developed under SDP2006 -32 was approved on May 31, 2006. • To our knowledge there are no open or unresolved zoning or building code violations. • To our knowledge there are no variances issued for this property. There are several special permits applicable to this property: SP2002 -14 & 42 for a garden center and contractor storage approved November 13, 2002. SP2005 -25 for outdoor display approved January 11, 2006. The subject property was issued several building permits and associated certificates of occupancy and appears to be in compliance with applicable building regulations. Permits from 1999 are not available; however the Records Manager may be able to perform additional research. Stevens 5592 Louisa Road Keswick, VA 22947 RE: SP -2002 -014 Habitat Services — Garden Center SP- 2002 -042 Habitat Services — Contractors Storage Tax Map 78, Parcel 33B Dear Mr. Stevens: The Albemarle County Board of Supervisors, at its meeting on November 13, 2002, unanimously approved the above -noted requests. Please note that this approval is subject to the following conditions: 1. The site shall be developed in general accord with the site layout plan titled, "SP 02 -14 Habitat Services Stewart Stevens Phase 1 and Phase 2" and dated May 28, 2002, and revised July 22, 2002; 2. The wayside stand permitted under SDP 02-42 shall be voided, upon the commencement of SP- 02-14 and /or SP- 02-42; 3. No tree removal or clearing shall be permitted beyond that expressly stated in the site layout plan titled "Site Layout Plan SP 02 -14 Habitat Services Stewart Stevens Phase 1 and Phase 2" and dated May 28, 2002, and revised July 22, 2002; 4. A separation of a minimum of four (4) feet between parking stalls and structures shall be required; 5. A final site plan approval shall be required; 6. Subject to the approval of the Architectural Review Board, the equipment storage area shall be screened to eliminate visibility from the Entrance Corridor; 7. The height of stored equipment shall not exceed the screening; 8. Subject to the approval of the Architectural Review Board, the piles of landscape material shall be contained and displayed neatly and /or screened from the Entrance Corridor; 9. The area for the storage /display of non -plant materials (other than the five [5] piles) shall be appropriately screened from the Entrance Corridor as determined by the Architectural Review Board; 10. Subject to the approval of the Architectural Review Board, the storage of landscape materials shall not occur within thirty (30) feet of the front property line and must be appropriately screened; 11. The plant materials may be displayed within thirty (30) feet of the front of the property line with the display approved by the Planning Department Design Planner; and 12. The use authorized by SP 02 -14 shall only operate during daylight hours. In the event that the use, structure or activity for which this special use permit is issued shall not be commenced within twenty-four (24) months after the issuance of such permit, the same shall be deemed abandoned and the authority granted thereunder shall thereupon terminate. For purposes of this section, the term "commenced" shall be construed to include the commencement of construction of any structure necessary to the use of such permit within two (2) years from the date of the issuance. Before beginning this use, you must obtain a zoning clearance from the Zoning Department. Before the Zoning Department will issue a clearance, you must comply with the conditions in this letter. This special use permit was approved based on the following conditions: 1. The outdoor display of vehicles shall be limited to the covered porches of the building only. Vehicles shall not be displayed elsewhere on the site, or between the northern parcel boundary and the EC; 2. Vehicles shall not be elevated anywhere on site; 3. The existing woodland on site, as indicated by the `.`existing tree line," shall be retained in its entirety, with the exception of that area necessary for installation of the septic field; 4. The existing four Sycamore (or London Plane) trees ( Platanus x acerifolia or Platanus occidentalis) located along the Route 250 East side of the property shall be preserved; 5. Tree preservation measures shall be included on the E &S plan and the grading plan (submitted with the final site plan) to provide for conditions #3 and #4, above. The E &S plan and grading plan shall include notes and details consistent with chapter 3.38 "Tree Preservation and Protection" of the Virginia Erosion and Sediment Control Handbook (current edition). Tree preservation measures shall be coordinated throughout the site plan set and E &S drawings. In the event that any site plan or E &S drawings show inconsistent information regarding tree protection, the drawing(s) showing the greatest tree protection shall prevail; 6. Site and building lighting shall be limited to the satisfaction of the ARB as illustrated in an ARB approved lighting plan submitted with the final site plan; Harding Page 2 of 2 January 26, 2006 SP- 2005 -025 Jarman's Sportcycles 7. Site and building signage shall be limited to the satisfaction of the ARB as illustrated in an ARB approved drawing included with the applicant's final submittal for a Certificate of Appropriateness; 8. The three board fence proposed along the Route 250 East side of the property shall align with the fence on the adjacent property to the west. The color of the proposed three board fence shall match the color of the fence on the adjacent property to the west; and 9. Additional plants along the east face of the building shall be installed to provide adequate screening. Plant materials shall be six (6) feet to eight (8) feet in height, spaced fifteen (15) feet on center, and should include Hollies, Leyland Cyprus and /or Cedars. Please be advised that although the Albemarle County Board of Supervisors took action on the project noted above, no uses on the property as approved above may lawfully begin until all applicable approvals have been received and conditions have been met. This includes: • compliance with conditions of the SPECIAL USE PERMIT; • approval of and compliance with a SITE PLAN; and • approval of a ZONING COMPLIANCE CLEARANCE. In the event that the use, structure or activity for which this special use permit is issued is not commenced within twenty -four (24) months from the date of Board approval, it shall be deemed abandoned and the permit terminated. The term "commenced" means "construction of any structure necessary to the use of the permit."
