In response to your request for a Letter of Zoning Compliance for the above referenced
Property, please be advised of the following for TMP 07600- 00- 00 -054A1 LYNCHBURG
ASSOCIATES LLC C/O GMH MANAGEMENTP O BOX 530292 BIRMINGHAM AL, 35253 -0292
(the "Property ")
The Property is zoned Residential, R -15. Multifamily dwellings are permitted by -right in this
district. No variances, special use permits, or zoning map amendments (rezonings) are
required for this use and there are no pending applications of this type for the Property. The
property is also in the EC, Entrance Corridor Overlay District
There are no legal nonconformities associated with this site.
The Property is subject to Site Development Plans, SDP2001 -00129 that was approved on
04/29/2002. The Property appears to have has been developed substantially per the
approved plan. In the event of casualty, the development would have the right to rebuild to
the approved site plan or amend the plan appropriately. A site inspection revealed two
inconsistencies with the approved plan; there are five (5) parking spaces shown on the site
plan at the northeast corner of the site that appear to have been incorporated into an
adjacent line of parking spaces, and the volleyball court appears to have been shifted to a
different location within the center of the development. At this time no complaint regarding
these inconsistencies has been received by this office. Thus, the County will not be
pursuing a violation of the site plan at this time. Any change to the plan should be approved
as an amendment to the plan sometime in the future.
• There is no record of any pending /open zoning violations having been filed with respect to
the Property.
• The Property was issued several building permits and associated certificates of occupancy
and appears to be in compliance with applicable building regulations
• Copies of site plans and certificates of occupancy may be obtained from this office with a
request through the department's Records Manager, Esther Grace, at 434 - 296 -5832 ext.
3823.
