In granting this waiver, the Agent finds that installing a single point of access would substantially impact environmental resources as well as features existing on the property prior to October 14, 2009, as described in Section 404(D)(2)(i) and Section 404(D)(2)(ii). The Agent also finds that an entrance required under Section 404(A) would lack adequate separation from the entrance to Link Evans Lane. As a result, strict adherence to the requirements of this section would result in significant degradation of the site and inhibit orderly development of the area. Ray, LS Johnathan Newberry County of Albemarle Department of Community Development & Zoning 401 McIntire Road Charlottesville, Virginia 22902 (434) 296 -5832 phone (434) 972 -4126 fax RE: Waiver of Section 14 -404.A (T.M. 31 -59) Dear Mr. Newberry: Land Surveyors Land Planners December 31, 2014 On behalf of the property owner, and in accordance with Section 14 -203.1 & 14.404.D of the Subdivision Ordinance, I am requesting a waiver of the strict requirement of Section 14- 404.A, that requires access to the building site from only one street, shared driveway, or alley established at the same time of the original subdivision, and shall have no immediate access onto any other public street. The waiver would allow access to the garage attached to the house on Lot 1, by way of the existing paved driveway that is located on the east side of the house, without any grading. Requiring both lots to use the same access would not be practical for the following reasons. 1. The construction of a new driveway on Lot 1 would require removal of trees and vegetation. 2. Grading and paving of a new driveway to connect to the existing garage on Lot 1 would disturb critical slopes and create unnecessary soil erosion, water quality, and storm water runoff. According to the Albemarle County GIS data, the existing dwelling was built in 1959. We contacted the Health Department and they do not have a record of the septic drainfield. We realize that Health Department approval is needed for septic drainfields for each parcel prior to subdivision approval. Dennis Seale of VDOT has visited the site and approved the existing entrance and the joint access as having adequate sight distance. Please find attached Exhibit A (including the aerial photography) and Exhibit B, each dated December 31, 2014. Both Exhibits show the existing house and driveway, and areas of disturbance, including critical slopes, to construct a new driveway on Lot 1. I believe situations like this are the reason for allowing a waiver of Section 14 -404.A and we are looking forward to your approval of this request.
