Driveway Alignment /stream buffer-
Mr. Grigas,
I visited the site on Dudley Mtn Rd this morning (TMP 89 -61A) to take photos and measurements, to evaluate
alignment that may avoid the 100' buffer.
I evaluated a stream on property, a perennial watercourse with well - defined channel and banks, and have photos
of this as well. Avoidance is possible.
If obstacle presents no alternative, 17- 604.A. specifies circumstance under which the County may allow
improvements within the landward SO horizontal feet of the buffer. In this case, avoidance is possible. A slight
turn NE on passing through a gate into a pasture is sufficient to maintain 100' between stream and driveway,
except at the very entrance. If avoidance is possible, it is a requirement. A slight turn on entering the gate
located 60 -ft NE of the stream would place the driveway outside the buffer. Please note that in all cases "any
new building site and sewage disposal system shall be located outside of the stream buffer" (17- 604.A.). Link:

When applying for a residential building permit, please show proposed driveway location at least 100' from
centerline of stream. No stream buffer mitigation (plantings) will be required for slight intrusion within buffer
at the very entrance to the property (Rte. 706). Had there been any visible or reasonable constraint to alignment
that avoids the buffer, plantings and stream buffer mitigation bond would have increased project expense.
Please make clear to building permit officials and contractor via sketch/narrative on building permit Application
that the driveway will be located 100' from the stream for its entire length, except at the entrance. Once clear of
hedgerow /trees, the driveway should pursue an alignment located at least 100' from the stream. A 40' turn
northeast would establish 100' distance, could then bear NW.
Proposed home site is located 500' -600' NW of Rte. 706.
Please also coordinate private /rural residential driveway entrance design with VDOT. Dennis Seale, VDOT,
has been copied.
I realize this may be disappointing news. Please feel free to call to discuss ordinance requirements, particularly
Sec. 17 -601, site conditions, or any circumstance I may have overlooked. A number of photos are available. If
interested in photos, please let me know.

The existing gate is to the right [north] of the stream. The blue line is to the left [south] of the stream and gate. I
propose the driveway to be to the right [north] of the stream in line with the existing gate. No tress or vegetation would
be disturbed in placement of the drivewy to the left [north] of the stream.. please reply with the redrawn blue line.
Please note that the gate is located in the break in the tree line along Dudley Mtn RD. Thanks, John Grigas

My understanding from speaking with you (5pm today), from descriptions and GIS image
attached to stream buffer development form d. 2/17/15, is that you would like to construct a
driveway to a new home site on Dudley Mountain Rd. /SR 706. Location of proposed driveway
is shown in blue marker on the GIS image, and is partially within stream buffer. I have not
visited the site, but earlier today you explained a spring gives rise to a 100 -yd stream on this
parcel (TMP 89 -61A). Could you confirm that the blue line in the Google Map image, below,
indicates approx location of the proposed driveway? I have tried to mirror the location on the
GIS image left with the development form. Also, is the green line in the second image below
also a fair approximation of the proposed driveway location?
We are comparing proposed driveway location with Albemarle County Ordinance Sec. 17 -604
(excerpt):

Please consider this section, and consider a slight bend in (green line) alignment that may help
keep the driveway within the landward 50 horizontal feet of the stream buffer.
For example, a single bend may help ensure that the driveway is fifty feet from the stream, while
still ending at the home site. This could be coordinated during construction.
Also, please explain if the proposed driveway will be paved, or gravel.
It is helpful to know that no trees will be felled or lost to construction in the proposed location,
that current land use is un- forested pasture. Please confirm if this is correct.
Your notes on the stream buffer development Application make clear there is an existing pasture
entrance (yellow highlight, gate), that alternative entrance locations on Dudley Mtn Rd (or Alt.
driveway alignment) may require additional length, grading, and land disturbance. Minimal
additional length to maintain the required minimal 50 -ft setback from the stream is, nevertheless,
important. Please confirm what you can.
I hope to respond to your request to develop within the 100 - stream buffer (second image) within
a day or two of receiving your response.
